Actually, I also had no problem either (Europe born), nor did my wife (Asia born)... at the same office when we originally did the same. In fact, I even told them that and they said "eventually Austin will figure it out." I told them we will take my chances. They kept saying that the rule changed in 2009, but I still know it was hogwash. I really do not know what they were doing that day -- obviously Austin felt a US Passport was sufficient since they sent the card just fine.

There is actually a controversy about passports because of a new (ridiculous) DPS rule that started Oct. 1, 2008 that says U.S. passports are only acceptable as proof of citizenship to get a drivers license if the applicant was born in the United States.

The rule is here:
Texas Department of Public Safety - New Texas Driving Laws (http://www.txdps.state.tx.us/administration/driver_licensing_control/LawfulStatusDLID.htm - broken link)

"
A Citizen of the United States or New U.S. Citizen:

The applicant must present one of the following:
  • Certificate of Birth issued by appropriate U.S. State, Territory, or District of Columbia;
  • Department of State Certification of birth issued to U.S. Citizens born abroad (form FS-240, DS-1350, or FS-545);
  • Certificate of U.S. Citizenship (form N-560, N-561, N-645);
  • U.S. Dept. of Justice – INS U.S. Citizenship Identification Card (form I-197)
  • U.S. Dept. of Justice – INS Identification Card for Resident Citizen of the U.S. (form I-179)
  • U.S. Passport may be used ONLY if it indicates place of birth in the U.S. "
If you are a naturalized U.S. citizen, a U.S. passport is not enough! Absolutely bonkers rule.

There are lawsuits about this, still pending as far as I can tell, and Democrats in the Texas Legislature tried to fix it but weren't able to.

We moved here from Tennessee and just went through this. My husband is working at Ft.Sam. After turning over his drivers lic. it really put him in a bind. He had a visa card with his picture on it and that is what he used to get on the base each morning. Tx photo id takes the same amount of time to recv. by mail. It only took abt. 3 weeks for his Tx lic. to come. You could check with your bank abt. a photo on your Visa/MC.

FYI- Virginia now mails drivers' licenses, too. I'm sure this will soon become the norm in every state.

Wow, am I glad I came across this thread! My husband and I are going to be relocating to Texas in 6-8 months and I would have been HOT if I didn't know this. I think we'll be getting passports before our move. I don't really want to go to that added expense, but I don't think it's feasible to be without a photo ID for long.

**Being from the Socialist State of IL, I'm surprised at this. We get our licenses on site here..... hmmmm.... maybe that explains some of the corruption in state government!

It's really not that difficult. Just follow the examiners' instructions and keep calm. They're really NOT there to fail you - just to ensure that you're a safe and competent driver.
