I purchased a house about 6 mths ago and allowed my childs mother and her 2 other children to live there rent free and with no kind of lease agreement to help her out alittle. When i lost my primary job i explained to her that she was either going to have to move or sign a lease agreement and start paying rent. She decided to move and said she'd be out by may 5th. Well 2 days ago via txts she informs me that she cant be out until june 7th. The problem is my ex said she doesnt want me on the propery(which i own) and that i was not to show the house until she is completely moved out. I had an appointment to show the house on may 7th to a couple who is intrested in renting starting in june. So i explain to my ex that she has to be out no later then may 31st and that i was still planning on showing the house next friday, but will i be breaking any laws by doing this?

This is a good idea. If you want to learn more about the legal aspect of this, just google "squatting". Six months is a good spell of time and if she has established residency, there may be issues... but I'm not an expert on this. Not at all.

Check with a lawyer. If you own the property you would have to do standard eviction procedures. You can look up the forms from the state of Texas. Downside is she can take like 3 weeks from the date you serve her papers. You could possibly take her to court for owed rent. But if you agreed she could live there rent free you are kinda out on that. Even without a lease she is protected for rent changes and eviction. 6 months really inst a big deal. But it is not like she was staying the weekend and you cannot get rid of her. You will have to formally evict her since she has established residency. Also she cannot stop you from showing the property since it is yours and you have no agreement saying you cannot show it while she lives there. However if she leaves it a big mess it can make it hard for you to rent it out. Also if the utilities are in your name and you have been providing them this whole time you are stuck with maintaining them unless you give her proper notice that she will be responsible for them. And i think again that is 30 or 60 days notice. And telling her verbally doesnt count. Its all gotta be paper trail. usually signed or mailed certified or served like a court summons.

This stuff isn't hard to find out about online. like I said they even have the forms for you to print out and tell you what to do.

Looks like you first written notice to vacate has to be for at least 3 days.

I am not sure. There is no contract, so how is she going to sue?

Constables are usually the ones that serve eviction notices and assist in evictions. Use this link, find your JP Precinct. There are downloadable forms on each of their sites to fill out to start the eviction process. Good luck.
