Hi everyone, my name is Mark Dickson. I am one of the many victims of the lending disaster. My problem started when I became injured and lost my normal means of income. I have since lost my home to auction and I'm having issues getting a place to live. I'm on social securtiy disability as is my special needs daughter. Together we make 748.00 a month. I can not work because of my injury and have lost everything. My question is this, I have been able to keep the lender off for 15 months of no payments but they are getting nasty now. I don't know why since we have had no new sales andmore vacant houses recently. I was told I may be able to squat. Can ANYONE help me with how I do this or if it is a real thing to use?

Technically this would be called unlawfully detaining (unlawful detainer). I wouldn't consider yourself a squatter, for they move into an already vacant dwelling by means of an unlawful entry, and have had no contractual relationship with the owner of such property. You in a since are merely holding over (Staying past the date the owner, in this case the bank asked (if they have done so) you to vacate).
With 15 months in arrears and the income you show, it is obvious you haven't the
means to enter into some form of repayment option offered by most mortgage companies.

That said your options are few, except for more attempts and prolonging the date at which the sheriff's office knocks on the door and gives you a few minutes to gather together only those belongings for which you can carry out in the time they allow.

Your best bet is ask the mortgage company to assist you in your move out. It is not rare or unheard of, that some (and most) will actually pay you to leave. It is less costly then going through the eviction process, a process that with very little legal knowledge, or the assistance of Legal aid can be lengthy, however ends with the same outcome, an eviction.

You may also ask for assistance from Housing and Urban Development (HUD), they may have openings for assistance given your income and situation. Keep in mind that currently their are new programs being offer by the government in light of the housing crises, and they would be the best source of information as to these types of assistance.

Bottom line however is your need to communicate with the lender, not doing so only prolongs the situation, places you more at odds with them and makes it more less likely that they be willing to assist you in any way. Face it your not the only one in this situation and they (The lender) know this. They will to attempt to keep the home from being a financial burden on them as well.

All I can say at this point is good luck and hope that anything I have said here can assist you in any way, and that I will check back to this post from time to time to see how it is going.

There is a different route that you should consider. You can ask the lender if you voluntarily quitclaim the property to them(saving them lots of time and money), they(lender) let you continue living there until sold. You agree to allow prospective buyers to tour the house while you are still living there. By living there you prevent the vandalism that happens to vacant houses, basically you would be providing a service to the lender by protecting the lenders asset for them. For this service of protecting their asset, you ask them to help you move, after the house is sold. You would both benifit. You must contact the lender A.S.A.P. The lender might not find this agreeable, but you won't know unless you try. The lender also gets the added bonus of being able to advertise they are a good samariton using ingenuity to solve the problem at hand.

Stall for a government plan that might a) offer a moratorium on foreclosures, and then b) allow repayment terms to be constructed that will cap your mortgage at 38% of your income.

Don't know if you will qualify, but that looks like a plan that might get launched.

My heart goes out to you. Unfortunatelly there are thousends in your situation. It is not your fault that you got injured. It is hard to comprehend that this country still hasnt lined up with the rest of civilised world. Worrying about tomorow in a country that runs on "Morals and Values" slogans is hypocritical. I could never understand why Republicans/Evangelicals that run on a religious "Morals and Values" platform are so prone to punish the weak, so unforgiving, so not tolerant, so pro war, so pro death penalty, so...etc
Is this what Jesus would do?

It's unfortunate that people would use this mans desperate plea for help and assistance, as some form of political podium by which they make statement without any offer of information, ideas or means by which he may receive assistance.

It must also be noted that throughout the world there is only a handful of countries which have banking systems which even offer home loans at all.

As far as caring, we are the most caring country in the entire world. However most of that heartfelt compassion is spent on those who can't stand the thought of us. But isn't that what Jesus would do?

Not any more, but that wouldn't change how I feel. It would seem to me that this once gun owner, offered the man and his family some sound advice, as did others.
That's what he truly needs right now, not a speech on politics. If you can't offer him any advice, then offer him a kind word, some encouragement, and leave it at that.
I'll leave it at that for we are both getting off topic, and not being of any help for the original man who posted his plea for help.
