Let me say one more time like I have for years now! Please read your ticket , all of it ! notice at the bottom there are several numbers vc 40513, c.p.c.853.9, Etc. then go one line and do the research for your self so you will understandclearly, those numbers are you defence to the action, breifly California Penal code 853.9 states (3) that at your areignment you can request that a verified complaint be filed. ( 1) states that in leiw of a verified complaint the notice to appear can be used to move forward "IF" the defendant enters a plea of GUILTYor No-Lo. #(2) says that if you ( in writing ) wave the filing of a verified complaint on the NOTICE TO APPEAR they can move forward. Now look at California Penal code 740, that states that "ALL" Infractions and Misdemeaner action "MUST" be prosecuted through a "VERIFIED COMPLAINT".

So now lets look at what has been said c.p.c. 740 says they have to have a verified complaint to take an action against you. Additionally Vehicle code 40513 says they same thing!.

The ticket they gave you referances c.p.c. 853.9 , That code tells you how that notice to appear can or can not be used in their action against you, ( although they don't explain that to you !). and when you go to court, in most casesd they don't tell you this , but they do ask you to sign a document thet you have been made aware of your rights in the case? , even given the fact that there is nothing on that document stating these inportant facts stated above.

Now you ask why is all this important? BECAUSE!!!! the cop that gave you that ticket can't produce that documet that their laws say they "MUST" have to take an action against you,
Now would that not be a constitutional violation of your right under U.S. Title 18, 241-242? ( Excessive use of authority under color of Law ) and also U.S. Title 42, 1983, ( Your) right to due process?. So whan anyone ask's what to do when you get a ticket , the answer is simple , DEMAND that pursuant to c.p.c.853.9 a verified complaint be filed and then watch then get mad , because they know they can produce it and will have to dismiss their action against you. Sounds tooo simple ,but it works using their laws. Every one needs to stop being the courts money cow .
