Why do you need an auto insurance attorney? More information will get results.

Did you mean auto insurance agent? I can't imagine any lawyer that would specialize in auto insurance. I have a great agent. PM me if you're interested.

Are you pursuing a claim against a third party?

I had some scratches on my bumper from when someone backing out of a parking spot rubbed against my car, and recently someone rearended me and knocked my bumper halfway off so now its barely hanging on. The other party was 100% at fault and thier adjster said they will not fix the bumper because it already needed to be replace before I got rear ended. There was no damage to the bumper other than minor scratches and the bumper was fully attached now its scratched up bad all over and is hanging on for dear life

Do you have pictures of what the damage looked like before the 2nd accident?

Why don't you file a claim with your own insurance company under your collision coverage and let them subrogate against the third party?

What he means is just file it with your insurance company and let them pursue and chase down the payment from the insurance company from the guy that hit you. If you weren't at fault, your insurance company should fight for you and help you.

It's NOT worth hiring a lawyer for something like this. It wouldn't make sense from a financial standpoint as there wouldn't be much in for him and it's something that you can spin your wheels and spend a lot of time on (as you probably figured out).

Just explain to your insurance company what happened. Ask them to cover it and then they will recover the funds from the other party's insurance if they were truly at fault.

Nailed it.

I'm not sure how underwriting for your company would handle the single small claim. Do you have small accident forgiveness? Do they apply a claim they subgrogated on to your experience?

I'm in claims, most worked for tpa's not insurance companies.

You might be best off taking them to small claims. But what's the cost of the bumper replacement? They only owe ya the actual cash value of the bumper, and if it was damaged that bad, that seems like a large dispute to me. It's why I asked for pictures before the second claim. So I can maybe eyeball it and see if they are being reasonable or not. Hard over the internet, of course.

Did they give ya a copy of their appraisal report maybe?
