I own a condo and a pipe had a leak between floors. At the time of the leak, we had moved out and were looking for renters. The water accumulated over our living room between floors enough that the roof of the living room caved in and dumped the water into the living room. We were alerted when a neighbor complained that there was water coming into their unit. HOA had a company come in and remove all of the water damage (rugs, flooring, water damaged walls, etc.) and dry the place out. When we initial talked to HOA, they said they would cover everything. Now they are telling us that they will only cover the walls and not the flooring.

Since the leak happened in the space between floors, and HOA were the ones that contracted the company that removed so much of the flooring, should they be liable to replace the flooring? I have a renter that would like to move in soon, but I am afraid with all of the work that needs to be done and the potential for mold that we will lose the renter (that took us 3 months to find) if we try to fight HOA about the cost of the flooring. Also, I don't think we have the funds currently to cover the flooring while we fight this out.

Any insight into our situation would be greatly appreciated. Thanks for looking...

Why stress over it... turn the claim into your Insurance Company and let them go after the responsible party...

Insurance Companies often only pay when they have to...

My brother who is not an attorney twice tangled with Insurance Companies and won...

Once was a bad traffic accident where his car was totaled by someone that missed a light... Insurance Company dragged it's feet for almost a year and lawyer's wanted anywhere from a 1/3 to 1/2 the settlement...

My brother Paid a Lawyer to prepare his case for filing... less than $300 and then my brother filed the case... the insurance company that wouldn't talk to him no wanted to settle and they DID

Another was storm damage case... that was going nowhere... he hired a roofer and carpenters to prevent further damage and went after his insurance company and won there also...

Sometimes you have to go through with the motions because it is worth more to you than anyone else...
