^^^ but these are condos not apartments. Yikes. I thought condos were built to different specs??? I hear my neighbors as well (no sex though). I would love to buy but can only afford a condo. Stories like this give me pause. It would be horrible to drop a heap of money on a condo and then have to live with hearing my neighbors. At least as a renter I have the power to move. Moving is probably your best solution. So sorry you are going through this. It would drive me crazy as well.

Many condos are no different than apartment buildings. Personally if I was going to buy something attached, it would only be a townhome. Unfortunately modern, nice townhomes are fairly rare in San Diego.

rule #1...never ever rent the bottom unit. You will hear everything, no matter how well constructed the place is (take it from a life long renter).

I had an upstairs neighbor who came home around 2 am every night and had a screaming fight with the gf, it was terrible and it was affecting my work since I wasn't getting any sleep. I complained to the ll and of course the people denied it. When they actually threatened me, I did call the cops. After that, the ll did move me to another unit, which turned out to be way better than the one I was in. And the trouble makers only stayed about 2 months after that anyway. Maybe ask your ll if you can move to an upstairs unit. If you think these people are there for the long term, you might have to move. Hey, you might want to try banging a broom on the ceiling when they are getting it on, that's always a buzz killer.

The one and only time I lived in an apartment building, there was a young couple who did the same thing. Another tenant, a welder, went over and pounded on the door and just screamed at them. That pretty much took care of it.

That's the thing, this is not an apartment building. We moved from a huge complex to this 8 unit place. In fact, every other place on this block is a house, not a condo/townhouse, so it's a very residential neighborhood.

All of these are privately owned and in 6 of the 8, the people that own them live there. Up until they moved in upstairs, the landlord lived in that one as well. We moved here in Sept, and they around December. We had no issues prior to that. It's expected to hear things when you share walls, but this is beyond ridiculous.

We tried the pounding...with a broom on the ceiling. Right in the throes of passion. Yea, it worked for that time and they did stop because I guess it just took them by surprise. But, they were back to it the following night! I'm almost to the passive-aggressive point, where I want to play loud porn sounds every single time they do it. Hey, being civil doesn't seem to work and they have no shame, since their landlord and HOA president talking to them didn't do a thing!

Easy, easy... Deep breaths... You still haven't tried *talking* to them. I'd bet dollars to donuts they didn't perceive your going to the landlord and the HOA before talking to them as "civil"

Again, it might just be too late, or they might just be jerks, but at least give it a shot!

Buy a cassette recorder, and every time they start making noise, tape it. Then play it back to the HOA. The other thing that you can try is making a lot of noise to disturb them.

I refuse to live in an apartment, and never will again.

Yea, we thought about recording it. I get you on the apartment...we wanted to rent a house but couldn't find any that fit our needs in this area and this place is really nice. It was awesome living here until they moved in. I love the neighborhood, they are dog friendly, and the other neighbors are really cool.

On a side note, how do you know ShelbyGirl? I just noticed up top it says you're friends with her. I know her probably a little too well these days and she is quite familiar with this situation!

I know ShelbyGirl1 from the Cats forum.

When I used to live in apartments, I had a couple doing the same thing, and also someone who snored. With the snoring problem, I just wore earplugs, or slept in the living room. With the couple having sex, I put a note in underneath their door, as to "could you please be a little quieter when you're having sex?" That took care of that.

But you can't get them under a noise ordinance, because they're having sex. You can speak to a legal clinic, and speak to an attorney. They should be able to send a letter to the owner with a copy to the HOA outlining the rules and regulations. If nothing happens, you can threaten to sue the owner. An attorney can give you more advice.

I refuse to ever live in a place that's attached again, and that includes upstairs and downstairs neighbors. My cottage is four feet away from my neighbors on each side, and unless someone is realy loud, we don't hear each other.

When we lived in Orlando, FL we had a neighbor that played this god-awful music (loud, beat-heavy gangsta rap) at all hours. When we approached him about it, nicely, he called us racist and that we just didn't want music that wasn't "white people music" to be heard. Hrm.

Anyhow, we tried to ignore it but apparently one night when we were gone another neighbor called the cops on him and he eventually got kicked out. The funniest thing is...the neighbor that called the cops on him was...uhh...the same race that he was.

We haven't, and never will ever again, live in an apartment/condo again. No way.
