According to news reports the San Diego city council will vote on a measure to condemn Arizona for it's new anti-immigrant law. Unlike San Francisco and Los Angeles, the city council of San Diego is not expected to call for boycotts of Arizona.

There was an article in yesterday's LA Times on GOP nervousness over a backlash from Arizona against Republicans running for office in California.

They should condemn foreign criminals instead.

1. It is astounding how many people have no problem trashing the constitution to solve a particular problem.
2. According to Arizona law, every person will have to carry proof that they are in this country legally.

3. This has never been required of any American aside from free negros prior to 1865.

4. This makes it a clear violation of the fourth amendment.

5. Solving the illegal immigration problem is certainly worthwhile, but not at the expense of our Constitutional protections.

6. The issue with the AZ law is not the enforcement of anti illegal laws, but it is with the burden of proof now required of every legal resident.

7. Guilty until proven innocent, is forbidden by our legal system.

I find it astounding that those who loudly and vocally support our Constitution are willing to trash it to achieve a political goal.

It reminds me of HL Mencken's observation that "Patriotism is the last refuge of a Scoundrel".

Louisiana practices Napoleonic Code which is guilty before proven innocent. I think that renders point seven moot.

No, it doesn't.

The civil code of Louisiana certainly features influences of French civil code and is less influenced by English common law. However, the Napoleonic Code was enacted in 1804, after what is now Louisiana was purchased from France in 1803, so not only does Louisiana not practice the Napoleonic Code, it never practiced it even when it was still French territory.

Also, even assuming you were right about Louisiana practicing the Napoleonic Code, the concept of presumption of innocence is contained in the United States Constitution (primarily in the 5th, 6th and 14th Amendments) and is enunciated in Coffin v. United States (1895). And where state law runs counter to the Constitution, the Constitution supercedes state law. Thus, that aspect of the Napoleonic Code would be void if Louisiana held to the Code (which it doesn't).

Tourists from AZ make up a significant portion of SD's tourist economy, they'd be stupid to call for a boycott of AZ.

Well we're talking about politicians, San Diego one's at that, so "honorable" doesn't really belong in the conversation here.
