A couple of days ago I moved into a new apartment with a one year lease. I do not like the new place. There is noise from children playing outside my window. There is so little natural light compared to my old place. My old landlord even offered to take me back. My question is whether there is a way I can get out of my new lease which I signed 30 days ago. The landlord is very nice. Should I just call her and tell her I want to move back to my old place for the above mentioned reasons?

Read your contract! Typically if a tenant wants to end their lease early, they will pay a cancellation fee and forfeit their deposit. The reasons you mentioned aren't valid enough to end your lease early without penalty and you shouldn't expect otherwise.

You have 3 options...

Abide by the terms of your contract and move at the end of the term.

Negotiate a move-out lease cancellation.

Just move and be responsible for unpaid rent and costs to re-rent the unit.

FYI... kids come and go and a few weeks ago was the shortest day of the year... meaning less light.

You might reconsider and give it a try.

Previously working in property management, you can always wait till you get a 3 days notice to pay rent and quit. Some properties I've worked at used these.

Skip paying on your first month, your landlord will serve you a 3 day notice to pay and quit, pay the for the month and bounce. A lot of properties do this as an easy escape out of the lease. Then again, you have to move in 3 days and be out by the time you pay.

It sounds like you rented my old place, LOL. Kids upstairs and outside, almost no light, despite nice big windows. Good luck, I ended up sticking it out for a year and moved out, 1 year to the day of signing my lease. My landlord was really nice as well, until I gave my notice, then they acted all offended and couldn't understand why I wanted to move into a house, with no adjoining walls, no close neighbors in a lovely area for $150 less a month.

Have you tried asking the landlord? Sometimes they'll let you out of the lease if they are able to find someone else to rent.

Well if you do get out of it, next time you're looking for a place make sure it has everything you are looking for.

Thanks for all your comments. I think at this point I will follow Ultrarunner's and EcvMatt's advice and will just stick it out. What I might do if it doesn't improve is move out say 8 months into the lease and just continue to pay rent until the lease ends. It actually makes it more difficult when you like the landlord because you don't want to do anything to inconvenience him or let him down especially since he thought I would make a great tenant when he first met me. I also signed the lease at his own home at the dining room table no less. Oh no! I'm family now. He asked if I would most likely stay more than one year. I said yes but luckily the lease itself is just a year. Hopefully it will go by quickly.

i can't believe 2 postings on the very same subject, noise! You can always call the landlady and see what she says, unfortunately you signed the lease, kids do make noise and as for the light, didn't you notice that before you signed the lease?

LOL, your landlord sounds just like my landlord. He used those exact words in an email response to my 30-day notice. He said, "I don't know why you would want to leave". Um, I want to leave because I just bought an awesome house for my family!
