I moved here from the east coast and after over a year of looking for work I finally found a production line box filler/puller job at a direct sales cosmetic company. We don't work a regualr work schedule. But, instead, 12 hours a day, 3 continuous days one week and 4 days continuous the second week. We get 1 1/2 times regular rate after the first 8 hrs of each day we work. Sometimes I am asked to come fill in for a different shift and what I would like to know is if I am in title to 1 1/2 overtime for the entire day I am asked to come in. I know per Federal minimun wage law any hours worked over 40 in a week is to be paid 1 1/2.

Example:

Three continuous 12 hrs days
8 regular hrs x 3 days = 24 regular hours
4 (overtimes hrs at 1 1/2) x 3 days = 12 overtime hrs at 1 1/2
Total: 36 hrs

Does all 36 hrs apply toward Federal minimun wage law or only the first 24 regular hours because I was already paid 1 1/2 for 12 of those hours?

How do you calculate overtime pay if another day is worked? I don't want to trouble HR yet because I am new to the company.

If I understand you correctly, you would be paid your normal rate for covering an extra day and that days did not take you over 40 hours for the week.

Daily overtime as you said are hours worked passed 8.

Weekly overtime are hours worked passed 40 for the week regardless if you had daily overtime on another day or not. They work separately for the most part.

I set up a similar schedule in California. As long as you have 40 scheduled hours, those 40 hours are at straight time.You wouldn't begin overtime until you had completed the scheduled hours in that day or come in on a day off.( i.e. the 13th hour on a 12 hour day).

Not Necessarily, it can mean in excess of 80 hours in a two week pay periond. I already went through this in San Francisco. Check with your UNION, if they have signed off on it then that's what it is.

Working an extra 12 hrs day or two would put me well over 80 hrs on a two week pay period overtime rule. Can't find it in the California industrial relations overtime rule section, does this rule apply to union workers only? Thanks.

Call Wage and Hour but in all probability there is a Union that approved this schedule somewhere. I've already gone through this in San Francisco. If the majority of the working unit approved the schedule then it is part of the contract.
