Buyer could also decide not to run it as an apartment building and instead convert it to a single family home.

You are in an awkward situation(not quite as difficult as a bad marraige) that might be made more comfortable if both sides could sit down together with some coffee and lay down some definitive ground rules for this transitional period. It just might ease the tension and make it easier for all concerned. Sometimes taking a step back gives a brighter perspective before things get totally out of hand. I always feel it is better to have good vibes than harsh living. I know it is easy for me to say at this distance but I thought I might put my two cents in.

well if you make it too tough on her maybe it won't sell and you will stuck with her. Don't cut your nose off to spite your face.

I totally understand what you are going through having been through it recently myself. My landlords were pretty inconsiderate of us well because they were blinded by their need to sell the place as quickly as possible. That was months ago, and as far as I know its still on the market (we moved out during the fiasco).

They called and told us...pretty much out of the blue...that they were going to be showing the place to a group of 30 realitors in a couple of days and then have a public open house that weekend "but we didn't need to be home for that." (!!!?) So in other words they expected to throw our home open to the public, for anyone to trapise through, but didn't want us to be home. And like you I found I didn't have a legal leg to stand on.

So I cut a deal with them that I would make sure the place looked nice IF they conformed to my schedule a bit more AND I would have to be present whenever they or anybody came into my house. They agreed but tried to wiggle out of it many times...like the time they called when I was on vacation half-way across the state (and yes, they knew where I was) and said they HAD to show the place that day. B#stards. Thank God I was moving anyway. They had some real gall though...they were so self-involved with their timeline that they even wanted to have an open house on my moving day!
