can anyone help ! i bought a home with the kb builders 6 months ago
the home was suppouse to be done by april 2007 but instead they have pushed back until agust 2007 i told them i could not wait because i am moving from state to state and my job transfer was cancelled i put in a request to cancell and two weeks later they responded they say because i was pre cual by a lender i could not get back my deposit. the home does not brake ground until august 2007 please anyone have suggestions help!!! i am single mom ...

Hi Jasmine,
Please take your contract to a real estate attorney (one in California, preferably in San Jose). Do not take the builder's word for it that the contract cannot be broken without the loss of the deposit. I'm a Realtor and know that while builder contracts are not the standard real estate purchase agreement, they have obligations to you that are likely spelled out in the contract - and if they aren't performing, you may well be able to get out of the contract. Just make sure you see a good Real Estate Attorney asap!

Default Real Estate Attorney

Try Richard Woon at Silicon Valley Law Group. I think he mostly deal with commercial real estate but I'm sure he can at least refer you to someone good. He's a pretty straight-up guy so he'll tell you if its something he can handle.
