A healthy tree falling is an act of God. A diseased or damaged tree left standing is a hazard that should be mitigated. I do believe the neighbor can be liable if they are warned about the danger of the trees, and they do nothing and damage happens, but you will have to sue if they don't volunteer, so better to try to be proactive and find a solution than to wait.

Definitely have an arborist come and give a written opinion.

Remove anything you don't want to replace under the trees.

Make sure your insurance will cover it.

Diana pretty much nailed it.
My family has dealt with this a few times.
One thing we don’t do though is expert insurance to do stuff for free.
They will raise your premium.
My wife is kinda big in the insurance industry .

An arborist evaluation with a certified letter would work but sounds rude.
An arborist report that you can hand them after you tell them that their tree is about to damage your property might be a bit more neighborly.

Talking direct is the most neighborly thing to do.
What route to take after that would depend on their response.

I had a house with a tree leaning towards my neighbors garage. I told him the tree may fall one day and hit his garage.

He asked if he could pay to have it cut down on my property. I said yes, and I would also help remove the peices. The tree was dieing anyway, a mostly dead tree.

Why on earth would a person who didn’t own the property a tree was on pay a nickel if the the said tree was a known hazard?
I just don’t get that.
Removing trees costs lots of money so this doesn’t make any sense to me.
To me this would be about the same thing as splitting the cost of an auto accident after a person hits you and is totally at fault.
Could it possibly be that they don’t know that they are not in any way liable and don’t have to pay?
Sounds very dishonest and sketchy to me.

Where I'm from that's called being neighborly. And one day in the future when you have a dead tree, hopefully your neighbor will split the cost with you, too.
