My mom had to leave her job at a daycare and relocate to las vegas without the 2 week notice due to my dad's health situation. Her Boss is now saying that because she didn't give her 2 week notice that she will not pay her the vacation time. Is this legal in Washington? I live in Las Vegas so I figured I ask this quick question if you don't mind.

Note: they had a person to back-fill her position already. I guess my mom must have mentioned at some point or they overheard that she was relocating.

No, it's not legal.

There is no legal requirement to give 2 weeks notice. You can quit right now and they can stop paying you right now. I believe that they do owe you for unused vacation days.

i'm not a lawyer though but it sounds like filing a complaint with the WA state labor board is a good next step.

Well, vacation pay isn't a legal requirement either. Basically it goes down to the contract. Does the contract say she forfeits her vacation pay if she doesn't give 2 weeks notice? If so that's the way it is...if not they're contractually bound to give it to your mother.
