Received a ticket on Edisto for operating a golf cart after dark. One, I am not the one who rented the cart and was unaware that this is in the rental agreement. Two, this is my first time ever on Edisto and knew nothing about the carts, there are no signs stating golf cart rules. Three, it was only 8:30 and still some light out. Officer said it's no points but if you don't pay the fine, they suspend your license. Worth fighting or no?
You were operating a motor vehicle on, I assume, a public road. It's your responsibility to know the law, pure and simple. It seems our judges are far too willing to ignore the dangers posed by irresponsible drivers, so you might get lucky, who knows? IMO, you got off lucky. There's a reason they are called golf carts. IMO, those who choose to drive them on roads should be shot on sight.
I think it could be worth fighting if it really was 8:30 when you got the ticket. I don't know the letter of the law, but I've generally heard that golf carts can only be operated during daylight hours. It's not too unreasonable to interpret that as "before sunset," and sunset today at Edisto Beach is 8:31. So I don't know. Worth a try if you want to go to court. I wouldn't hire an attorney or anything if no points were involved.
But yeah, the fact that there were no signs doesn't excuse you from the law, unfortunately. If every law had to be posted, there'd be no room to put anything else.
