He's suing the wrong people. Everything he claims was said was by comments on the story. Go sue the trolls, doofus! Hopefully he (and other wasters of court time) learns a valuable lesson and is made to pay all court costs, including the 10k an hour ESPN lawyers.
Baseball is a horrifically boring sport for players and observers. On these grounds the case has merit - how dare they besmirch this individual for sleeping during such a slumber inducing event.
