That's one of my main gripes about where I live now (Philadelphia). Even though laws are in place banning smoking in bars/restaurants and public places here in Philly, people have no qualms about sitting outside and blowing smoke into your house. The neighborhood I live in has far more smokers than non-smokers. I can't even keep the front windows to my rowhouse open on most nice days because I have a chain smoking neighbor who sits out front puffing away, guess where it goes..? I can't wait to get to a place where smoking isn't a birthright. Speaking of birthright, my formerly pregnant neighbor across the way would religiously sit outside and puff her brains out thoughout her term.

Your choice of which side to sleep on doesn't affect anyone but yourself and whomever you sleep with.

But smoking on the balcony affects my health when my neighbor below smokes heavily. I pay rent for my apartment; why should I have to endure my neighbor's pollution?

Then there should be smoking and non-smoking apartment buildings. It's pretty clear-cut.

What is clear cut is that smoking should be banned altogether. It's an addiction. We need to protect people from Themselves. It's their own health that is at risk, and mine too with second hand smoke!

It always kills me to see such beautiful people inhaling a cigarette knowing they are slowly dying of cancer. GRrrrrrrr!

Yeah, let's ban cigarettes. We should ban alcohol as well, and diesel-spewing trucks and buses since all three of those things can hurt people. We should also start banning things I don't like, because I feel like my opinion is the most important and that everyone should listen to me. Say goodbye to Mountain Dew and turkey meat, then.

I think you're being a little ridiculous and off topic here. People simply want to go out and have a smoke free atmosphere. I dont think asking that is hardly asking a lot.

No, I understand that, but banning cigarettes is an extreme way to do that, as is banning smoking on balconies or walking down the sidewalk. Banning it within twenty-five, fifty feet from a doorway is wonderful and some places do that. There's just no enforcement, for whatever reason.

Exactly, I don't like people texting and yaking on the cell phone while driving, and the guys who drive gas guzzling SUVs that put more pollution in the air than my four cylinder car, and their tires are way bigger than mine so the production of them polluted the air more.

And the neighbor who puts Seven Dust on his yard for fleas and then kicks it up with the lawnmower. And the senior citizen who is driving around on umpteen presciption meds causing wrecks. The guy who painted his house down the street, the vapors are gettin in my lungs. Sob Sob......someone call a Wahmbulance for me.

Here's some advice for the apartment dwellers.......quit sitting around on the balcony so much and work harder to save some money to buy your own home with a yard and you can live in your smoke-free environment.

I'm semi retired, I moved here one year ago, and I picked this apartment specifically for it's location and the view. I sold a home in NY and have absolutely no desire to own another one, what with the upkeep and all.

If I wanted to buy something I'd purchase a condo in a building, and then I would likely still have smoking downstairs neighbors under my balcony as it seems like most people down here do smoke.

I wasn't targeting anyone specifically but the point I was trying to make is when you live in an apartment you should expect to put up with a fair amount of undesirable consequences. I've been there and done that and hated when people would park in my designated spot, kids running around making noise above me....one guy underneath me would cookout every Sunday and get drunk with his friends and be noisy watching football.

I happen to be a smoker, but if it was bothering someone above or beside me I'd stop it if it was asked of me and I think most people would. Or perhaps if you have a balcony electric outlet, plug in a small oscillating fan to blow it out the area.
