Yes if some one is tailgating me...I slow to a crawl...if conditions allow I will go above the speed limit in the (within 5-7 mph) middle lane... not in left lane I know that is the "big boys" lane...left lane is for speeding...!

I think the proper characterization would be that the owner is also liable for the acts of the driver. Of course a party is going to go after whoever has the deepest pockets, but it's also inaccurate to say that the driver of a vehicle has no personal liability for their own negligent acts just because they're driving a vehicle owned by another person. Both the driver and the owner share liability, unless of course it is a rental car or leased vehicle. In that case the owner doesn't have any liability under both state and federal law.
