It's nice that they finally passed the bill. But why does it have to be a secondary offense? Wouldn't it be nice if a cop could just pull someone over and issue a ticket if he observes them texting? And a $30 fine is not much of a derrent.

But that would infringe on someone's right to be a menace. Much better to wait until there's an accident to issue a $30 ticket.

That's because they are the ones texting! So imagine if you passed a law that would not let you do what you are so used to doing!
I wonder why in NY its possible and here it isn't.

any new law shoudl have a period of time of warnings,,, $30 is high my weeks groceries or gas,,, and it is NOT a criminal offence!

I know it's not a criminal offense, but it should at least be equivalent to a speeding ticket or even careless & reckless. The person texting can't even get pulled over unless there is some other moving violation. And most people would not bat an eye at a $30 ticket.

I believe that is why this law is so weak. Even though there was only one "no" vote it seems clear he is not the only one who feels that way.

It IS a violation of our rights to issue a ticket for something you do within your home or vehicle.

What I'd like to see is an officer trying to PROVE that someone is texting and driving, wouldn't it be as simple as deleting the text before the officer approaches the vehicle?

Are they going to violate your privacy by subpoenaing your phone company for your text message records? Do those even exist?

They need to pass a ban on texting and driving. Way too dangerous to innocent drivers and pedestrians.

Enforcing and proving it becomes problematic, though.

The officer word is enough...just like when you run a stop sign and only you and the cop are around to see it (happened to me)...and it's not a violation of your rights...you can't drink alcohol in your car but you can in your home(21)...you can be naked in your home but not in your car...you get my point...

That is complete nonsense. Are you saying people should not get ticketed/arrested for drinking or using drugs in their car? When it comes to public safety our liberties take the backseat.
