Hey ALL!!

Can someone post date a rent check? Example: If my rent is due between the 1st & 5th and I have to mail my rent to my landlord on the 2nd in order for him to get it on the 5th before the close of business (when the mail man runs). But I dont get paid until Friday. I am afraid of him getting to soon and I wont have the funds. So i was thinkign that i could mail it off today and post date it for the 5th, to buy myself a little time. Does this sound logical?

Yes, you can do that. If your LL is an individual you might want to call and give them a heads up.

When I was in banking it was against the law to post dat a check. When the payee receives the check it is a negotiable item.

I can remember back in my Army days, G.I.’s were always short of money and the Italian/Chinese food guy coming around the barracks yelling “Pizza, eggrolls, fried rice! We take post-dated checks!”

So, the Italian/Chinese food roach coach guy is ok with it.

Not really,OP?
Just tell your landlord that you are going pay your rent from now on on the 5th.
Part of reason that I got tired of being a landlord was all of the BS that people try to pull.

If you are having financial issues...let him/her know..and see if you can work something out.
Most people will work w/ if you if you don't play games.

If rent is not due until the 5th the LL shouldn't have a problem holding the check until the due date. It's not like trying to float a check past the date due, although I suppose if you want to get strictly technical about it... it's illegal. It's illegal to speed too, but we all do it anyway.
Besides it's going through the mail, odds are the LL won't receive until a few days later anyway.


Doesn't sound like the OP is dealing with a faceless corporation that will deposit it without looking at it. All the LL I ever had were pretty good about working with me on stuff like that. A simple phone call should take care of it.

Do you get paid every friday? If so just talk to your LL and set it up to pay them on the first Friday or Saturday of each month. Then you wpn't have to worry about the rent check clearing before your pay check does.

I would much rather get a post dated check before the rent is due then get a check after the due date,but dated the due date.

It is illegal to postdate a check.

If your landlord decides to hold it until you say it is okay, well, that is up to him or her, and not for any of us to say.
