Hi everybody,I turn 21 in August and live in Midland.I tried buying O'Douls and I got carded.I tried to buy at a restaurant tonight and no place that I know of will sell to anyone under 21.I dont know why.I talked to a state trooper who talked to the Texas Alcoholic Beverage Commission who said that they said that you do not have to be 21.So why would noone sell near beer to people under 21 when its legal.I think the state trooper is a credible source but Im beginning to wonder if he was right or not.Thanks in advance.

Because it contains a slight amount of alcohol, and the risks aren't worth selling one beer.

It takes 48 O'Douls to equal the amount of alcohol in a regular beer. With that, that means there is alcohol in it. Must be 21! No bartender or liquor store is going to risk their license on that one.

You must be 21 to buy an alcoholic beverage. Look it up yourself.

Unless you're with your parents or legal guardian, or your spouse is over 21, you cannot be served... unless you go to some country where the legal drinking age is lower.

Even then, no bar will serve someone underage.

Just because a state trooper said it doesn't make it correct. You cannot be served an alcoholic beverage if you are under 21.

As far as I know, there is no privilege for an establishment to sell to a minor if accompanied by parents, but even if there was, I can't imagine any place would actually do it. The reward is too minimal and the risk too high.

Sec. 106.03. SALE TO MINORS. (a) A person commits an offense if with criminal negligence he sells an alcoholic beverage to a minor.
(b) A person who sells a minor an alcoholic beverage does not commit an offense if the minor falsely represents himself to be 21 years old or older by displaying an apparently valid proof of identification that contains a physical description and photograph consistent with the minor's appearance, purports to establish that the minor is 21 years of age or older, and was issued by a governmental agency. The proof of identification may include a driver's license or identification card issued by the Department of Public Safety, a passport, or a military identification card.
(c) An offense under this section is a Class A misdemeanor.
(d) Subsection (b) does not apply to a person who accesses electronically readable information under Section 109.61 that identifies a driver's license or identification certificate as invalid.
