Do not invite scarmig to ride with me . Be sides as I keep saying Texas is not the only state to to plead the 9th , 10th & 2nd amendments and is also making a law that would state that the federal goverment has no jurisdiction if firearms are manufactured in Texas,Montana etc. The states are waking up to the fact that they do have rights beyond the federal government.

As to get to the point though, it is "telling" that you use the adjective "comparitively" when discussing a free society. Don't you think?

Kinda reminds me of a very close personal friend of mine -- don't agree with him on much at all -- who always talks about how Americans are "undertaxed"

Here is the thing though...

What is the standard we are being "compared" to???? And why should it be accepted as the standard?

There are too many violations to name, but you know as well as I do, that "speech codes" are actually in force on many college campuses. At some point in time when a successful couple work themselves up from the working class up into the upper-middle class, they suddenly become the "bad guys" ...and get taxed to the point it punishes their hard work...only to go to those who never contribute a damn thing. When a Supreme Court rules that private property can be taken for "public good"....far and away beyond what was ever intended under the auspices of imminent domain? Something is VERY wrong here when this just becomes accepted and nothing to be done about it.

I guess what I am saying is while some people's notions of freedom might be measured against the quasi-socialist European Union? Well, mine are stacked up against what was intended by our Founding Fathers. Classic Freedom. And they would tell us we are a bunch of wimps, wussus and cowards to have traded in notions of abstract "union", equality of outcome, and nanny security, for the true freedom they only asked we -- their grandchildren and greatgrandchildren and all the way down the line -- had the guts to keep...

As Calhoun said "The Union, next to our liberty, most dear"

Even if I am not -- which I am not -- a secessionist -- I very much sympathize with some of those who are. And further, I have no doubt our Founding Fathers would be...

Actually, my own "compromise" is something many Americans don't even know exist. That is, the "Constitutional Convention" approach! Essentially, the soveriegn states do not have to secede per se...but simply meet in convention and "abolish" the federal government as exists and rules us today. Kick it out and re-affirm the original Constitution and get us back what we used to have...a true federal government.

In the first five weeks of his presidency, Barack Obama has acted so rashly that at least 11 states have decided that his brand of “hope” equates to an intolerable expansion of the federal government’s authority over the states. These states -- "Washington, New Hampshire, Arizona, Montana, Michigan, Missouri, Oklahoma, [Minnesota]...Georgia," South Carolina, and Texas -- "have all introduced bills and resolutions" reminding Obama that the 10th Amendment protects the rights of the states, which are the rights of the people, by limting the power of the federal government. These resolutions call on Obama to “cease and desist” from his reckless government expansion and also indicate that federal laws and regulations implemented in violation of the 10th Amendment can be nullified by the states.

Not only have they implemented the 10th but also the 9th and 2nd amendment. Along with this they are putting laws on their Constitutions as part of states rights that any firearms made in these states, the federal government can not touch,which is part of states rights.

You keep bringing up the military but I hate to burst your bubble but the military takes an oath to protect the U.S. Constitution, not the President or the federal government. They will not rise up against their own people if the people and the states are defending the Constitution and abide by the Constitution. This is also a part of the U.S. Constitution.

This booklet contains the Campaign for Liberty - Taphouse (C4L – TAPHOUSE) version of the Texas Tenth Amendment Citizen/State Sovereignty Resolution (10A-SR) and the Creighton / Berman House Version (10A-CBV) to be voted upon on March 13, 2009.
Introduction:

You may have heard that 10 states in the union have passed “state sovereignty resolutions” which assert their sovereignty over the federal union as creator over it to determine if the federal government is in compliance with the terms of its constitution. Another 10 states are presently considering such a resolution.
Unusual Opportunity to Unite Patriots in every Area of Defense:

We at the C4L – TAPHOUSE meetup group have discovered that a well written 10A-SR can unite patriots from sea to sea merely by listing all the federal violations of the Constitution and showing where it has changed its form without the consent of the people who created it by amendment dissolving the federal union.
Needs:

Review and compare the two versions of the 10th Amendment Sovereignty Resolutions.
Send this booklet to your representatives in the Texas House and Senate.
Make copies of it and give them to your friends to submit to their representatives.

R E S O L U T I O N
WHEREAS, the Constitution of the State of Texas, Article 1 Section 2 declares “All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit. The faith of the people of Texas stands pledged to the preservation of a republican form of government, and, subject to this limitation only, they have at all times the inalienable right to alter, reform or abolish their government in such manner as they may think expedient,” acknowledging that the Citizens of Texas are the sovereign makers and un-makers of the State of Texas to preserve a republican form of government made up of laws for the sole purpose of protecting the life, liberty and possessions of each and every citizen; and
WHEREAS, the Constitution of the State of Texas in Article 1 Section 1 declares “Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States;” acknowledging the right of every state in the union to make all laws for its own governance where the U.S. Constitution does not delegate it to the union; and
WHEREAS, Article IV Section 4 of the Constitution of the United States of America declares that “The United States shall guarantee to every State in this Union a Republican Form of Government, ****” wherein those in Union authority guarantee that no part of the federal government will usurp any authority from the states not delegated to the Union; and
WHEREAS, Thomas Jefferson said that all American ideals of liberty came from Algernon Sidney’s Discourses on Government 1683 and John Locke’s Two Treatises of Government 1689 and Locke identified five ways to dissolve government by the violations of those in its authority all consisting of changes in the form of government without contractual acceptance by the people, i.e., amendment; and
WHEREAS, there is not enough paper, much less lawful currency in the form of gold and silver, in the world to fund a nation that does not follow its own constitution; and
WHEREAS, the founders of the states and federal government did not leave economic matters impacting the United States of America unaddressed subjecting the states and union to arbitrary storms of global proportions rendering the states and union victim to greedy financiers with schemes of making all nations debtors to a global banker oligarchy, but determined all matters of economics within the same body of constitutional law that protects all other property of the citizens; and
WHEREAS, the sole purpose of all lawful government is the protection of the property of each citizen consisting of their life, liberty and possessions and has no lawful authority to be an engineer of global democracy or to be a generator of domestic or global economics; and
WHEREAS, there is no authority for any lawful government to declare and conduct “global wars” against terror, evil, ugly, poverty or any other idea or doctrine or nations that hold people with such ideas but must restrict its war powers to those delegated to “repel invasions” and stop nations who have clearly inflicted damage upon the United States of America; and
WHEREAS, even the congress cannot make war but is limited by the U.S. Constitution to the declaration of a war already in progress against the United States of America upon suffering a significant and obvious damage to the people of the United States of America; and
WHEREAS, the Preamble to the Bill of Rights of the Constitution of the United States of America declares that “The conventions of a number of the States having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added,” expressing the intent of the people of the states to limit the power of the federal constitution to the those only written in the federal constitution with the second amendment if necessary; and
WHEREAS, the Ninth Amendment to the Constitution of the United States of America declares that “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people” assuring the people that the delegation of one authority does not imply the delegation of another authority similar or related that is not delegated; and
WHEREAS, the Tenth Amendment to the Constitution of the United States of America declares that “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people” limiting the power of the federal government to those specifically delegated in writing and the people and states retain all other powers, written and unwritten; and
WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and
WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by “We the People” through their representatives of their respective states to be an agent of the people and the states acknowledging that both the states and the citizens thereof are sovereign over the federal government for the sole purpose of protecting the life, liberty and possessions of each and every citizen of their respective states; and
WHEREAS, today, in 2009, the states are demonstrably treated as agents of the federal government to control, oppress, and plunder the property of the citizens of the several states; and
WHEREAS, many federal mandates are directly in violation of various provisions of the Constitution of the United States and the Tenth Amendment; and
WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and
WHEREAS, a number of federal laws and proposals from previous administrations and some now pending from the present administration and from Congress violate the Constitution of the United States; now, therefore, be it
RESOLVED, That the State of Texas and the citizens thereof hereby assert their recognized and guaranteed sovereignty to exercise their God given, Constitutional recognition and authority to find, determine and judge that the following actions taken in the future or already enacted by the federal government violate the Constitution of the United States (USC) dissolving the federal union:
1.Establishing martial law or a state of emergency within one or more of the States comprising the United States of America without the consent of the State legislature(s) as there is no delegation of such power from the states or people to institute martial law and there has been no “invasion or rebellion” as referenced under Article I Section 9 of the USC; and
2.Requiring involuntary servitude or governmental service of any kind pursuant to, or as an alternative to, incarceration after due process of law; and
3.Requiring involuntary servitude or governmental service in the military of persons pursuant to, or as an alternative to, incarceration after due process of law; and
4.The use of the “Federal Army,” or the “National Guard,” or other combat ready military against the citizens of the several states in defense of a “federal or union government” that has been dissolved by changing its constitutional form without consent or amendment; and
5.The continued surrender of any power delegated or not delegated to any corporation or foreign government including an unlawfully proposed “North American Union;” the foreign ownership or operation of any toll roads or ports of entry in any state of this union; and any use of our military by the unlawfully organized government called the “United Nations;” and
6.Any act regarding religion; any limitation on the freedom of political speech including laws regarding so-called “hate speech;” or any limitation on the freedom of the press (1st Amendment USC); and
7.Federal infringements on the right to keep and bear arms of any kind including prohibitions of type or quantity of arms or ammunition (2nd Amendment USC); and
8.Continued Federal imposition of “Federal Reserve Notes” or “Bills of Credit” or “any Thing else but gold and silver Coin in Payment of debts” (Art.1 Sec.10); and
9.Continued issuance of unlawful paper currency by a private banking cartel (Federal Reserve Bank) at interest (Art.1 Sec.10); and
10.Continued Federal funding beyond two years of a Federal standing or acting army without a “declaration of war” (Art.1 Sec.8); and
11.Continued failure of the Federal Government to “provide for organizing, arming, and disciplining, the Militia,” of each and every state in the Union wherein no state can guard their borders adequately or deter the federal government from violating the U.S. Constitution (Art.1 Sec.8); and
12.Continued use of the INS (Immigration and Naturalization Service), now a part of the unlawful “Department of Homeland Security” to guard borders rather than perform their constitutional duty to assure all the requirements of becoming a citizen are uniform in every state (Art.1 Sec.8); and
13.Continued “Capitation, or other direct” tax on wages (defined by the U.S. Supreme Court as property, rather than income, defined by the U.S. Supreme Court as profit from return on investment) made by individual citizens of the several states earned in the states without “Proportion to the Census or Enumeration hereinbefore directed to be taken” (Art.1 Sec.9; 16th Amend); and
14.The continued imposition of ancient monarchial common law, from which “We the People” narrowly escaped, revived in the unlawful “Federal Tort Claims Act” that usurps sovereignty from “We the People” in order to intentionally, or otherwise, harm the People and every class of their property even unto death without judicial recourse unless waived by statute or congressional resolution, denying the People a just repair essential to the sole purpose of their state and federal governments and to all civilized nations; and
15.The continued relinquishment of authority over the United States armed forces into the hands of foreign entities and unlawful combinations such as the “United Nations;” and
16.The continued unlawful use of Federal funds to purchase private banks or the assets, good or bad, of private banks including those of the unlawfully organized “Federal Reserve Bank;” and
17.The continued unlawful Federal borrowing of credit from the unlawfully created “Federal Reserve Bank” operating unlawfully in the United States of America or any other bank for the purpose of buying other banks or the assets, good or bad, of private banks; and
18.The continued unlawful use of Federal Funds to bribe private banks to make unlawful “loans of credit” to American companies, corporations, and state citizens; and
19.The unlawful “borrowing of credit” from banks to “create infrastructure jobs,” or, “create clean energy manufacturing opportunities,” or, “help global economics,” or, “make payroll for state employees,” or, create any kind of so-called “economic stimulus,” which constitutes the economic or debt crisis the Union suffers at present; and
20.The continued failure to impose constitutional protective tariffs on goods imported into the United States of America that undermine the manufacturing capacity and work force strength and independence of the United States of America; and
21.The ongoing federal mandates in public education that have overwhelmed the states with burdens that outweigh, obscure and destroy the real purpose and curriculum of public education limited by the authority of each citizen to teach only the principles of property that regulate every aspect of lawful government for the protection of the life, liberty and possessions of each citizen; and
22.The creation and operation of the unlawful “Department of Homeland Security” that unites all the law enforcement branches of the state and federal government destroying the rights and liberties of the people and the checks and balances of multiple police departments and separate jurisdictions that can investigate the activities of each other; and
23.The institution of any requirement to obtain an Identification that carries any kind of radio frequency emission or magnetic charge or contains information about the person’s character, convictions or history of any kind; and
24.The unlawful relinquishment of the war power by the acquiescence of the U.S. Congress and violently exercised by the usurpation of the president of the United States of America recorded in PUBLIC LAW 107 - 243 OCT. 16, 2002 AUTHORIZATION FOR USE OF MILITARY FORCE AGAINST IRAQ RESOLUTION OF 2002 changes the form of government agreed to in 1789 and unaltered or amended to this very hour thereby dissolving the federal union which cannot be redeemed by any act of the federal officials or officers after dissolution as they are without the authority of “We the People” to do anything; and
25.The continuation of the unlawful undeclared war and unlawful occupation of Iraq and Afghanistan which eats out the substance of the citizens of the several states without delivering any right to them to build a “democracy” or any other kind of nation in either nation and grants a God given right to the people of said nations to fight us until we leave; and, be it further,
RESOLVED, That this resolution serve as Notice and Demand to the federal government, that they are dissolved by their own miscarriages and have left the states without a union to protect the property of their citizens and that they cease and desist, effective immediately all of the foregoing; and, be it further,
RESOLVED, That the State of Texas notice all other states that it is repulsed by any secession from any lawful union or interested in any break up of the union into any smaller region of states as proposed by our governor or inclusion into any union with other nations as proposed by our last president but is committed to the protection of the property of the 50 states by a lawful contract binding on the union officials; and, be it further,
RESOLVED, That the Texas Legislature move to establish a permanent committee to meet with other states to discuss measures to safeguard the property of the people from continued infringement by those who claim to be officers of a dissolved federal union of states; and, be it further,
RESOLVED, That all powers previously delegated to the United States of America by the Constitution for the United States shall revert to the several States individually and to the People. Any future government of the United States of America shall require ratification of three quarters of the States seeking to form a government of the United States of America and shall not be binding upon any State not seeking to form such a government; and, be it further,
RESOLVED, That the Texas secretary of state forward official copies of this resolution to the president of the United States, to the speaker of the house of representatives and the president of the senate of the United States Congress, and to all the members of the Texas delegation to the congress with the request that this resolution be officially entered in the Congressional Record as a memorial to the Congress of the United States of America; and, be it further,
RESOLVED, That a copy of this resolution be sent to the counter part of the Texas secretary of state and speaker of the house of representatives of each of the 50 states once comprising the United States of America; and, be it further,
RESOLVED, That the Governor of the State of Texas call up the militia of the State of Texas (Article IV Section 7 Texas Constitution) consisting of armed citizens (Article I Section 23 Texas Constitution) to guard the property of the people against any intrusion of “federal troops,” foreign troops or people without proper visas, and internal riots agitated by unauthorized foreign influence.

RESOLVED, That this serve as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers; and, be it further
RESOLVED, That all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or that requires states to pass legislation or lose federal funding be prohibited or repealed; and, be it further
RESOLVED, That the Texas secretary of state forward official copies of this resolution to the president of the United States, to the speaker of the house of representatives and the president of the senate of the United States Congress, and to all the members of the Texas delegation to the congress with the request that this resolution be officially entered in the Congressional Record as a memorial to the Congress of the United States of America.

Listen, it seems you concentrate only on the glimmer of what you see within your little microcosm and forget about the rest. You use a smallest sample to somehow judge the whole. It really sounds personal to me.
I don't watch TV.
My toilet should not be mandated.
History should always be open to various interpretations.
Safety features should be optional.
I think I've taken decent measure to protect some measure of my privacy, but it's hard to be sure. They don't exactly notify you of that.

Of course it's personal. The people these things happen to are your countrymen! How is that not personal? How can you, who love this country so much, not take personal affront to how the government treats so many of our own people?

Waitaminute... did you just validate your view based on "you're an American"? I say "your" government because I stopped voluntarily participating or accepting responsibility for the Federal government years ago. The Federal government has made it imminently clear that it views me as an enemy, and I have no desire to consort with them. It is your government, because you still claim it, you still voluntarily participate in it, and you ultimately bear some level of responsibility for it.

I do not claim responsibility for the Federal government or it's actions any more than I claim responsibility for the mugger who has stolen my wallet and used my money to buy crack.


It's real simple. I'm a peaceful man who wants to be left alone to live my life. For reasons I cannot fathom, many people view that as a mortal sin.

scarmig, I understand where you are coming from to a point. Marxism engaged in politically correctism and we have moved closer to this situation in this society. Socialism is the beginning and like I said before if Barack Hussein Obama keeps going at this pace we will end up with no one being free. Political correctness is what they intend to control all of us with. When you are not free in your home, not free to speak what you feel is right, in other words, even if it is not against the law,it is, if you are not politically correct. We as a society have let it go to far,even if you are peaceful man, you eventually will have to fight to keep that peace that you want so much. It is not a mortal sin to want to be left alone, but this particular government is not going to quit till they control everything that we do or say. I would like to be left alone, too. But that is not going to happen.

Freedom is not free,Eventually you will have to fight for it in some shape or form.
