i am a student in guelph and having been living at this apartment for this school year (leased from may 2012 til april 2013). I agreed to sign another years lease (until april 2014) and signed but have npt sent my 12 post dated cheques to our land lord. I recently found out i will not be in returning to guelph next year so i know longer need the apartment. Am i legally allowed to cancel the lease even though i have already signed? what are some options? anything would help!
Ah the young. I would call your landlord and explain the situation to him. He's going to find out at some point. If you have a good relationship you can likely just get him to cancel it no hard feelings, you're giving him a good chunk of time here and hopefully you've been a good tenant. Otherwise, since he has no leverage (no money!) his other option would be to sue you which as a student you probably don't have much in the way of assets he can seize. So tell him, apologize, explain life happens, and he should be fine. If not, wait for the letters from the lawyer and then ignore it. (note: not a lawyer, but been around a bit).
