Well, depending on the make of the luggage, many manufactures state and specific that those handles are internal and not protruding parts of the case. The CoC states "protruding" as in those collapsable handles that are on the outside or moulded into the external part of the case, but if that system is withint he internal case, its not excluded under the CoC.
The airline will tell you its excluded and they will fight you on it all the way. BUT, many people are starting to learn how to fight back. You sue them in SMALL CLAIMS COURT where the airline may be barred from having an attorney present. You provide the CoC that shows the conditions and a statement or manufactuing specification that shows the handle system is Internal to the case and the protruding defense goes out the window.
So in this incident, if the handle was one of those that are internal, the only thing the airline can use to not be responsible for it is failure to make timly claim.

but the person can send an email every 5 minutes to the head of customer services as I now have their email address and ask all their friends to reply incl the CC to such person for as long as they can be bothered because they have nothing better to do....
Am planning to spend the day tomorrow leaving voice mail

yes petty and small minded but quite frankly I have paid for unlimited internet and I will use it ..... If I clog up the system and customers don't get through then that would be a real shame...
