I'm assuming you're in the UK...you didn't say.

Just so you know, it takes years, unless you have some special skill (actor, model). Apply now.

You need to enquire at the United States Embassy or Consulate in a city in whatever country you live in. The U.S. government is the only reliable, authoritative source of accurate and complete information about its immigration laws. At an Embassy or Consulate, you can sit down and discuss your questions with a person on the Embassy staff, take notes, and receive brochures which explain the laws..

If you have a passport from most Western Europe countries, you can arrive in the US without a visa and be granted temporary visitor entry. But cannot apply for a visa while in the US, you would have to return home and start the visa process from there, for a longer stay.

But you can't legally work on a tourist visa. If you're caught you'll be deported and not permitted back.

Question:

I'm a French citizen who entered the US on a student visa but overstayed by a month or two, dont recall and have a misdemeanor and another arrest for failure to go to court. I'd like to re-enter, I tried and was told I was not in trouble but not enough time had pass for me to re-enter, its been over five years now and would like to know if a visa is required or should I not even bother?

A ban on re-entry can be up to 10 years for overstay. I would encourage you to get in touch with an immigration lawyer to assess your situation.

Do you realize this question was asked nearly 4 years ago?
