There was a case near Syracuse, NY a few decades ago where a man who was accused of raping and sexually abusing several young teenage girls was found to have a brain tumor in an area that affected his ability to reason and he was found not guilty due to "temporary insanity" as a result.

The tumor was discovered and removed while he was incarcerated awaiting trial. It had apparently changed his entire personality, and his attorney asked the court to have him mentally evaluated, and the shrink was the one who suggested a CAT scan to look for abnormalities. Once the tumor was removed, he reverted back to his "normal" personality.

So I guess it's plausible, but in the case referenced in the original post, I'm not really buying it.

Brain tumors and endocrine disorders can affect personality, as can psychiatric medications. However, I don't buy the "back tumor" defense. Hogwash.

I think a person should pay for their crime, regardless of the reason why they committed that crime. Now, the punishment could include a variety of degrees of psychological counseling or possible mental incarceration options....but never a slap on the wrist and a pity party.

There are LOTS of seriously mentally handicapped folks out there who don't commit crimes on other human beings.....much less children.

Tumors can reduce your ability to think things through, or hold yourself back from doing something stupid, but they CANNOT give you a split personality. And if he were a split personality, he would not know that he did it, this he would not be able to admit to it.

What a bunch of deep-dyed sheepdip this is.
