"This court finds by clear and convincing evidence that the offence for which Mr Simmons was convicted, sentenced and imprisoned... was not committed by Mr Simmons," she said in a ruling.
Mr Simmons was 22 years old when he and a co-defendant, Don Roberts, were convicted and sentenced to death in 1975.
At first I misread this as getting paroled.
But this is great news, but also sad news at the same time.
The man has spent nearly half a century , and almost his entire adult life in prison.
He can leave with his name cleared as well.
The 2nd guy mentioned is much younger, and can at least can make something with his life from here, after such another terrible injustice.
It's this type of outcome that makes me question the need for the death penalty. The state basically robbed the guy of his life, but at least he's finally been exonerated and gets to spend a few remaining years as a free man.
