I can not reiterate how concerned I am at the guilty verdict rendered in the Greg Kelly trail. The moment the charges were filed this young man's life was altered. With a verdict of innocence he would have still had an arrest record showing sexual assault of a child.
There is no evidence at all this assault happened. NONE!!!
A child under 5 tells professional counselors twice nothing happened. But...
a police detective is able to interview the boy and the story changes. So charges are brought. A second child tells of molestation after an interview with the police. Then recants. Again No Physical Evidence. None!
Then the detective admits to not following correct procedure in the interview. D.A Jana Duty offers a plea deal with no jail time. She knows case is weak. NO PHYSCAL EVIDENCE! But yet this pool of jurors finds this young man guilty. Why? Because the child's mother told the story so well on the stand. Hearsay testimony. Do these jurors not understand the law? Are these folks just uneducated nuts? NO evidence! I cannot blame a weak defense. Ms Cummings is one of the best defense lawyers in the state.
True witch hunt with a willing jury. Beware karma.
As for D.A Jana Duty. She just had her Michael Morton moment.
This child will come forward years from now and recant. Mark this post.

It was reported today that he passed on a plea deal for probation proir to the trial. Wow. I cant imagine having my life in the hands of some of the dumbest people on the planet. The term "jury of peers" is a really bad joke.

But most rape cases do not have any physical evidence, because most rape victims do not come forward for a loooooong time, and you only have about 72 hours to collect that evidence before it's gone forever. (Even less in reality, because being raped makes you want to get in the shower again and again and again and burn the clothes you were wearing and pour bleach on the sheets.) They clearly made the decision based on whose story was more consistent and convincing -- and if hers is more convincing then his must have been shaky indeed. And believe it or not, rape victims do typically recant and then go back and accuse again, based on whether they are feeling more angry at the offender at that moment or more afraid of him. So the recantations may have paradoxically helped convince the prosecution that they had a case.
