Hi all. Trying to calculate my wife's unemployment benefits.

She was let go on May 14, 2010. On Monday, May 17, 2010 she filed for unemployment. Then there is that week of no payment. She has been receiving her weekly payment while she looks for work.

Does that mean her OC date is May 17, 2010 making her eligible for Tier 1?

In NJ, the original claim date should appear in the benefit determination and in each "claim for benefits" form.

Assuming your wife is entitled to full unemployment, she should complete her first 26 weeks of basic unemployment November 13th. HR4213 for tier purposes requires she exhaust her first 26 weeks of benefits no later than November 20th to qualify for Tier 1.

So, yes, assuming her benefit year begins May 17th, but no later than May 24th, she should be able to move onto Tier 1. (I have counted the weeks - lol)
