I'll break it down so you can see if I have a legitimate right to appeal.

Initial Claim - October 28, 2008 for max weekly benefit amount
*I was claiming up until May 1st, 2010 in which I obtained a job and then got laid off due to lack of work on August 1st, 2010.

Filed new claim and received 12 weeks of unemployment with max weekly benefit amount.

Just found out today that I am not eligible for any additional benefits since I didn't work 20 base weeks although my earned wages were double the minimum of $7300 during my employment.

My question is that do I get penalized on unemployment benefits because I got a job? Meaning I took the job, but could have still collected if I didn't get the job. But now because I worked for 3 months they considered it an entire new claim and I lost the EB or EUC (not sure which tier I was in at the time) that I was receiving.

Do I have a right to appeal based on these details?

By my calculations, you collected 77 weeks before beginning work in May - 26 weeks state benefits, 51 weeks tier benefits. You should have two weeks EUC tier benefits remaining at most. You may want to check your records on that.

Normally, once your state benefits from the second claim are exhausted you are put back on what remains of your previous claim.

However, I am not clear if you would also qualify for 20 weeks EB on that first claim. In WI, we are clearly told if we open a new claim, our rights to EB on the previous claim are lost.

However, NJ, by state law, must pay EB if certain triggers are met - which in your state they are. So, NJ may handle this first claim/second claim issue differently.

Are you sure they are not putting you back on your old claim? Sometimes you are told you have no further benefits available when that is not the case.

Call or visit NJ unemployment and ask about that - the remaining two(?) weeks of Tier 4 and possible EB - all from your first claim.

Thank you for your response - the letter I received today stated I am not eligible to receive any additional benefits to the 12 weeks that were issued. However, this was only for this most recent claim. Nothing was stated about my previous claim on the letter. I will contact my unemployment office and see if I can "get back" any additional weeks I would have had remaining on my previous filing.
