Dear Breville: As soon as I recieved notice I would be recieving proceeds from the lawsuit, I went into one of the IDES offices and asked what the proper handling of the situation would be. I was told the earnings would have no affect on any part of the UI process. I was told it does not affect your earnings, benefit year, or employment status. As I moved from one suburb to the other in 2010 I had a total of 4 Illinois Unemployment offices tell me the same thing. Word for word, "it does not affect anything they do in the unemployment office".
Dear Breville or anyone else who may know: The actual terminology being used is that I should have a second benefit year since I have earnings in the 4 Qtr of 2009. That is the earnings from the law suit. But, am I wrong in thinking that I already have a second benefit year in 2009. That is I became unemployed in August of 2008, I worked for a short time in December 2008 and was continously unemployed until late May of 2010. I had either 13 or 14 weeks left of the 99 weeks. So, are they trying to create a 3rd benefit year? Perhaps I do not understand the lingo.

You should check the codes yourself. I think, based upon what you have written, part of your $1,000 earnings ($500) from the lawsuit could be considered wages earned. The IDES reps that told you otherwise could be wrong. Read the codes and any related case law.
Dear Zaj2: I have checked the 2010 code and they do not cover the situation. They do seem to say that for 2010 only earnings that come from the Employer are counted as earnings. However, they also do things out side of their rules. For instance base period, it states the first 4 of the last 5 fiscal qtrs. but if you bring in your most recent pay stub they will put them in the system and include them in your earnings. So, this is as much just common usage as anything else.

You are eligible for another 20 weeks of Tier I EUC and possibly 14 weeks Tier II EUC provided you have exhausted all your benefits under Tier I not later than December 24, 2011. Illinois should transition you automatically onto Tiers I and II.
KEEP CLAIMING after your initial 26 weeks are exhausted. If there is any type of a lapse, call IL immediately.

Your friend is talking about the Extended Benefits program for up to an additional 20 weeks which requires work searches in order to maintain benefit eligibility. Whether or not that program will be in place next year when you might have eligibility will depend on Congressional extensions of the unemployment legislation. Currently, eligibility for EB and the other tiers expires December 31, 2011, and most EB payments stop entirely January 7, 2012, although any current EUC tier on which you are collecting as of December 31, 2011 may be exhausted into 2012.

Hi guys. Really interesting thread. I have a question regarding the original issue.
I began benefits in IL on June 13, 2010. I received a letter of denial stating that I had not earned 3 times my weekly benefit (1164.00) since June 13, 2010 and therefore I am uneligible for a second benefit year. I did not work at all except for a 1099 I got for helping out at a church which I did put on my taxes, but did not disclose when I certified to IDES, nore does it show up on my UI findings. The amount of the 1099 would exceed the 1064.00 though.....
So am I done with benefits? Or does the 'new claim' get denied and I go back to the original? Or do I have to file a different way with a new base period or something? I read another guy's post who ignored the letter and they denied him benefits the next time he certified, so I'm just wondering what I have to do......
