Can I reapply for texas unemployment benefits if I was not eligible?

I didn't qualify for unemployment benefits in texas due to the base period wages. I filed unemployment on May 2011. I worked Nov, Dec 2010. Jan, Feb,March,April and got fired at the end of May 2011. Can I reapply for Texas unemployment benefits in July if I have not found a job? Will I be elegible for unemployment benefits according with the base period wages? I already read the texas workforce commission website and it is not clear to me, this is the reason why I am asking through this website. Thanks in advance for your help

Reapply, absolutely, in July. You should have your answer immediately. April and May wages will not be included in your new base period. Does TX website give info on base wage numbers? Compare your wages for Nov.-Mar. You could also call TX and ask. Won't hurt.

Fwiw, many people delay filing for unemployment because of what you experienced. This is a universal problem in every state.

thank you for you answer....

now this is my story, do you think I have a chance getting unemployment benefits:

I worked in an office where the doctor yells at the employees. I addressed my concerns about being treating this way from the doctor. I asked to be treated with respect and professionalism. I addressed that the employer doesn't have to raise his voice to me to perform properly.
Two days later I was fired by the office manager. He stated he can't treat me with respect, that we have a personality confilct and I didn't mold to their office style of managing employees. At my exit meeting, the office manager stated my performance was good, but they couldn't manage me without yelling and being respectful.

They may contest your claim, especially since it will be so late coming after the termination. Sounds like they probably would have contested it anyway, though. If they do, there will be an investigation. Chances are no benefits will be paid until there is a final determination.

But, since you were fired, that is one plus. Document, as best you can, the sequence of events so if there is a problem, you are prepared.

Ariadne, I do have another problem and I would like to know your opinion. In nov and dec 2010 my employer gave me 1099 form. from jan to may I was a regular employee. is this going to affect my base wages??

1099 wages are not included in base wage calculations. Only eligible wages would be Jan.-Mar. Depending on how TX calculates, you may not have enough weeks and/or wages. Better call them.

Had you worked anywhere on W-2 prior to this job in the last 18 months? If so, those wages could be included in the base wage calculation even though that employer's UI account would not be affected.

nope I was a student. when calculating base wages do they use pre-tax or after tax wages??

There is also the option of waiting until October to apply. Then Jan.-May wages would be included, which would provide a larger benefit for a longer period. Ask TX if you can do that.
