Im currently on TIER 3 of a 2009 claim that is due to be up in the end of AUG this year, will I collect EB for my 2009 claim or will I move on to Tier 1 of my 2011 claim.

Eligibility
Your most recent regular claim must have exhausted all available benefits by December 31, 2011.
• The last week Texas can pay EB is the week ending January 7, 2012.
• You can’t be eligible for unemployment benefits on a new regular claim in Texas, in any other state, or Canada

When it says exhaust all available benefits from most recent claim it looks like it means i would not collect EB from my 2009 claim as I still would have all my Tiers left on my 2011 claim.

EB for your 2009 claim no longer exists. When a new claim is opened, EB on the previous claim is forfeited. EB is only available on the last claim, if earnings qualify.

Your state should transition you to Tier 1 of your 2011 claim, assuming that claim qualified for EUC tiers. EB should be attached to that claim, if your earnings qualify. However, without further Congressional extension of unemployment legislation, EB in most states will cease January 7th.

@Ariadne22 thanks I called the local office twice now and could not get an answer, I really hope they extend the cutoffs if not a lot of people will be left homeless
