Hi,
I am really struggling to understand all the new laws and changes and figured I could ask for help and clarification.
I am in my 41st week of claiming.

State: RI
First unemployment check: 8/9/2012
Amount: $544

Ok, am I understanding "new" tiers correctly?

State Unemployment: 26 weeks (8/9/11 - 01/30/11) - $544
EUC Tier I: 20 weeks (2/6/12 - 6/18/12) - $544
EUC Tier 2: 14 weeks (6/25 -9/24) since I will already be in it when on 8/27 tier lenght changes - Will the benefit amount change? It says 54% off benefit? Will it go down to $367?
EUC Tier 3: 9 weeks (10/1-11/26) 35% of benefit amount, does that mean $238?
EUC Tier 4: 10 weeks (12/3 -2/4/13) if extended by Congress past 12/31/12. 39% of benefit amount -$265?
EB: 13 weeks (2/11/12-5/6/13) Is this abolished?
EB: 7 weeks (5/18 -6/24/13) Abolished too?

I read somewhere on this site that RI EB benefits will end on 6/9/2012, regardless of the unemployment rate. Is this true?

So to sum it up, my question is, when will my benefits expire and how the benefit amount changes over tears? Hopefully I'll have a job soon and won't need the benefits any longer, but it drives me nuts that they made this so complicated (almost like tax law!) that even well educated smart people have a hard time figuring it out. I'd like to figure it out.

No. Tier 2 is 14 weeks, which is the equivalent of 54% of your original monetary determination (26 weeks). The weekly benefit does not change.

No. Tier 3 is 9 weeks, which is the equivalent of 35% of your original monetary determination (26 weeks). The weekly benefit does not change.

No. Tier 4 is 10, weeks which is the equivalent of 39% of your original monetary determination (26 weeks). The weekly benefit does not change.

Under present legislation, you will not exhaust Tier 4. All EUC benefit payments end 12/29/12 regardless of remaining balance. Unless Congress extends legislation into next year, your Tier 4 payments end December 29, 2012.

EB: 13 weeks (2/11/12-5/6/13) Is this abolished?

Yes, projected to be June 9th.

Yes, projected to be June 9th.

I read somewhere on this site that RI EB benefits will end on 6/9/2012, regardless of the unemployment rate. Is this true?

Yes, unless RI experiences a rising UE rate which causes its three-year lookback to remain above 110%. Unlikely. Latest BLS report shows RI at 111%. Next report should put it below 110%, at which time RI will trigger off EB.

confused on RI Unemployment....my husband was only approved for 10 weeks and it will end in 2 weeks....I am confused on how to figure out if he is eligible for EUC? Getting worried...

Review his original monetary determination letter when he was granted benefits. It should list earnings on which the benefit is based, by quarter.

In RI, in order to qualify for EUC, he needs to meet one of these three qualifying criteria:
  1. base-year earnings covering at least 20 weeks, or
  2. base-year earnings equal to 40x his weekly benefit, or
  3. base-year earnings equal to 1.5x his highest quarter.

This was a new job... Started to work Sept. 15, 2011 and laid off April 27, 2012. They only have listed 2
quarters, what about the quarter for January - March? Is that not included for some reason? I am not familiar with Unemployment...I have never collected before.

If your husband qualifies for even the minimum benefit using the regular base period method, that is the benefit he gets. ABP's only apply if there is no other way to qualify (w/the exception of NY). This per RI:

RI Department of Labor and Training Employer Charges, Unemployment Insurance
You husband qualified using the regular base period method which excludes the quarter in which you file and the quarter preceding that. Therefore, if he filed in April/May, RI will use earnings from January 2011-December 2011 (excludes Jan-Mar/Apr-Jn 2012).

Had he delayed filing until July, 2012, RI would have used April 2011-March 2012 earnings, which would have increased the length of time he could have collected to a maximum of 26 weeks - and possibly created EUC eligibility. However, by filing in July, of course, you would have foregone benefits for six or seven weeks. Many claimants delay filing until the next quarter after the layoff in order to increase their benefit.

Your alternative now is to call RI and complain about not being advised that by delaying his application for benefits until July he would have qualified for much more than ten weeks, possibly up to 26 weeks, and EUC when his state benefits are exhausted, if Congress extends legislation.

I do not know if RI will reconstruct the claim at this point. CA has done this on appeal. You might want to consider filing an appeal. Ten weeks' benefits is very short.

One other question. Does he have an earlier claim with unexhausted EUC benefits. If so, RI should be transferring him to that when the current claim benefits are exhausted.

If not, then you should appeal when you receive a denial of EUC benefits. You might find a sympathetic ALJ.
