State = Georgia
Hello everyone. Thank you for helping me in advance.
My mom was denied for Social Security Disability (SSDI) in Nov of 2011. She decided she wanted to attempt to find a job while still seeking SSDI. She applied for Unemployment Insurance and she did note on her application that she had Early Onset Alzheimer's. Her Unemployment Ins benefits were still accepted. In June 2012 she received her letter of SSDI approval and a check with back-pay starting Jan 2012 to June . She stopped claiming Unemployment Ins as soon as she was accepted for SSDI.
My questions:
Would she have to pay back the state Unemployment Insurance from January to her last check in June?
My mom stopped claiming Unemployment Insurance as soon as she was accepted for SSDI. Would the state consider the lump sum backpay from SSDI a one time income source when she was not claiming Unemployment, or would they consider the backpay a month to month income that needs to be repaid?
We want to do the right thing and make sure we are taking the correct steps.
Thanks so much for everyones help!
This really is a question that you need to ask to the UI department in your state, as there are a LOT of variables. Although my guess is that, as you are not able to get UI and SSDI, they may have questions on how she was able to be "able and available" for work but still qualify for SSDI
The real issue though is that OP is asking about benefits and SSDI payments that cover the same time period. Collecting UI Jan-June and then receiving money from SSDI in a back payment to January.
