I was fired from my job.It was not 'Gross misconduct' and I was not fired immediately. It took about 3 days for the employer to call me in and give a notice. I appealed to EDD for benefits and was interviewed. I was very truthful on the interview. I thought it went well. I'm still waiting for a 'determination'. About a week after the interview I started receiving claim forms and checks.
I just got another claim form for 2 weeks. I was kind of surprised that I received the money and I'm poised to receive more. Should I believe that a determination has already been made and that's why they're paying me? Thank you ahead of time for your help.
Since you were discharged, there is absolutely no reason to incriminate yourself by being truthful. Whenever EDD asks why you were terminated, you say, "I don't know. Ask the employer." At a minimum, the next 6 months of your life depend on not boxing yourself into an indefensible corner. Only after you hear the employer's version of your termination do you tell EDD your side of the story.
If you're actually getting money from EDD, then a determination was made, but that doesn't mean that your employer won't appeal it, and you might have to pay it back.
What if I been collecting benefits from a few weeks but not received a letter for interview questions and those questions listed in the back of the letter are about holiday severance pay. Which part was before or after taxes. Should o be concern about the call? Should I even ignore the call since it’s to simply clear severance payments amount or can they denial future payments because this ?
