First of, hi all! :wave:

This question is re: my boyfriend's claim. He first filed with CA EDD last year. His claim expired on 9-22-12 but he had exhausted his benefits about 3 weeks before that. He's yet to receive anything in the mail, and based on what we've gathered on EDDs website, they should file the first extension for him.

Obviously given the importance of one's benefits, it's hard to wait so long. Should he have received correspondence closer to when the money ran out, or will it now only be making it's way through the system now that the claim has run out?

ANY help or insight is appreciated!

If your boyfriend has worked at all since becoming unemployed, CA will NOT file a new claim at the bye. Your bf must do that. If your bf has not worked, CA will automatically file a new claim at the bye, provided your claims remain continuous.

However, what do you mean he "exhausted his benefits about 3 weeks before" 9/22? He should have received at least one more set of bi-weekly claim forms before 9/22.

CA normally does pretty well when transitioning between tiers and at the bye. It may be a tier exhaustion occurring so close to the bye has held up processing. He should call EDD to check his status. Some good contact info on the last three or four pages of this thread:

He has worked slightly, but he was only receiving 'gap' unemployment (forgot the actual term for this), as his hours were reduced from full-time to part-time and, very recently, to no hours. This also happened to me (same employer), only I had filed my original claim months before his; I, too, reported earnings while on my original claim but never had a problem transitioning (I'm on Tier 1); I started receiving claim forms again with only a slight break but I couldn't recall the exact time frame when it happened to me, but I also know it's only getting busier and busier at EDD, so I figured that had something to do with the delay for his.

Thank you for the link! He'll call tomorrow to find out what's going on then with his claim. Again, thank you so much.

Now I'm curious, any idea why my claim transitioned without a problem..? I had also reported earnings off & on throughout my original claim, but I never had to re-file myself, EDD did it for me. Hm.

Have you gone through a bye, as yet? Transitioning from state benefits to a tier, or from tier to tier, in the same benefit year is not the same process as recertifying the claim at your benefit year end. If you didn't work at all, CA will do this automatically, without any glitches, usually. Lately, they are saying if you've worked, you need to file a new claim online at your bye. They won't do it for you. However, they may not be consistently adhering to this.

Since your bf has worked part-time, he probably exhausted his state benefits three weeks ago. If that is the case, he should have transitioned to Tier 1 by now.

The only other issue would be your bf may have had a small claim which does not qualify for EUC at all, thus the lack of communication from EDD. This happens frequently. In order to qualify for EUC, base-year earnings in the claim must equal 1.5x high quarter earnings, or 40x his weekly benefit.

His original monetary determination letter will list at the bottom the quarters used to qualify him for this claim. If you can find that, you can do the calculations per the above formula to see if his claim qualifies for EUC.

I exhausted my original benefits on 9/30. Yesterday I received a letter that said I qualified for FED benefits and that the CA EDD had filed my claim automatically. I then called in my bi-weekly claim. I am just waiting for my money to be deposited onto my card as normal. Although I am curious if once on FED benefits, instead of bi-weekly claim/payments, does it change to weekly claims/payments? So does that mean I need to call in every Sunday?

Nothing changes. Biweekly claiming, as usual.

Hi. #1: My Ca BYE expired March 9, 2013. I still had 444.00 left. I was able to find PT work throughout the benefit year but nothing that lasts. I think I made enough early into the benefit year to file a new claim but I will only get about 25% of what my orig benefit was. Because I worked does that preclude me from getting a Fed extension on my original claim?
#2: I met all of eligibility for CTB except for the Eligibility of the Barber College. My appeal determination said the school was "not approved by the director". There is at least 1 other student who appealed it and EDD accepted it. If I appeal (again) would the argument be that it meets criteria of self training(it just isnt formally accredited) but has been in business 70 years and ends with taking state cert exam.
FYI: I am attending PT to keep UI eligibility but can and would like to attend FT

Yes - it certainly does - if you did not exhaust all your state benefits before your bye. You need to establish eligibility for EUC before your bye (3/9/13). Now that you have a new claim and didn't collect EUC earlier, you don't qualify for CA's DNCP (claim deferral) program either. Had you collected at least one week's benefit under EUC, payment on this new claim could have been deferred until you had exhausted all EUC from the first claim.

Appeal, of course. If you know the argument the other student used (assuming his circumstances were similar to yours), use that. We rarely discuss CTB on this board, so it is doubtful anyone here can help you with that.

Thanks for the reply. So it appears as if you are penalized for trying to find work. Of course my objective has always been to get enough hours to sustain myself w/out UI.....just doesn't happen in slow seasons of hospitality work.
I am confused though. I don't have a new claim as of yet. Due to yet another sep appeal about UI eligibility( which I won) I just received my last payment on yesterday March 22. 2013 as edd was bringing my claim up to date ( and through the BYE date). is it still too late and alo would I have had to run out of money too? It is prob a moot point but I am trying to figure this out. Thanks again.
Also do they ever grant an appeal just based on your written argument returned to appeals office within the 20 days? Or is it pretty much you are given a hearing date with a judge? thanks again.
