Question about possibility of a new claim when current claim runs out?

If you haven't worked since January 2012, there are no eligible earnings on which to base a new claim.

Certainly, you can file. Don't expect an approval.

hi I'm confused maybe it's just me but please help.....im new to collecting unemployment and by the way im in nj...but back in August 2012 I opened a claim but I was denied ....so I got a new job in Feb 2013 and now as of july 2013 due to an accident Im now unemployed once again. So I still had my username and password I went online and filed a new claim.. it looks like I was approved I had a phone interview and when I go online it looks like I'm getting a check but the claim is still dated August 2012 ?! can anyone explain this when I looked at the base years mine doesn't fit with anything is this a mistake should I say something or is this what its supposed to say this is almost a year later no new date? Please help

Many states stick with the "only one new claim per calendar year." So, NJ is reopening your old claim.

But, you say that claim was "denied." Was it? Or, were you disqualified from collecting benefits for a certain period of time?

That claim is still on NJ's books for some reason.

Have to ask, though - you're filing for benefits now because of an "accident."

Were you hurt?

Are you able to work now?

If you are physically unable to work, you are disqualified from claiming until you get a doctor's release.

Also, the bye for your "old" claim will be soon. At that point, NJ could open a requalifying claim using all your new earnings in 2013 plus some from your previous employer.

Doesn't sound like your first claim was "denied." Something else is going on, there. If you do collect benefits on that claim, it won't be for long, because you'll have to call NJ at the bye to recertify, at which point NJ will find new earnings for a new claim.

I have work all my life and had to go on umployment.. I had to use the extended and thenof course they stop in Dec. 2013.. I am working part-time and wondering if I can open another claim for partial or something?

Has your claim expired?? If not, you need to wait until your benefit year-end to apply. Your part-time earnings should allow another new claim.

Depending on:

1. your state's partial benefit formula,
2. the weekly benefit amount of the new claim, and
3. your current part-time weekly earnings which need to be reported when you claim -

you will or will not receive a net benefit after earnings are deducted from the new weekly benefit amount.

Each state uses a different formula for partial benefits, which is why we always ask your STATE:

1. Please include your STATE when posting a question. State laws/precedents differ. It is often putting the cart before the horse to discuss a quit/misconduct/claim issue without first knowing your STATE.
