So how long does it usually take for a ruling? In the handbook, it said up to seven weeks. Hope others got it faster than that

Under two weeks. I would think you will hear next week. CA does not usually drag its heels.

OK, good news. I won my appeal! The judge ruled that my termination wasn't warrant. I didn't purposely inflict harm on the company and I warned then that I would be absent before I clocked out early due to my illness. Target attempted to say that I was a no-call no-show, but the judge seen that their dates didn't ad up and believed my testimony over Target's hearsay. Thank you so much you guys I really appreciate it.

Appreciate the update. All it takes is persistence. These reviewers should not be denying on simple issues like this. Any of us here knew that decision was wrong. But it seems they never step out of the box and push everything up to an appeal - waste of everyone's time.

Your welcome. I think Its the duty of everyone here who post a thread to give updates. Its only fair for viewers and the people here who help and council. I have another question though, My unemployment started in January and my claim expired, then was put on a federal extension that expired on December 29, 2012. With the new legislation signed into law, will I be able to get another extension and how long? I recieve 180 a week, will this amount change as well?

You have to count the weeks of payments received so far. CA is currently paying all four tiers. If you had a full 26 week claim, you are entitled to

26 weeks state benefits
20 weeks EUC Tier 1
14 weeks EUC Tier 2
09 weeks EUC Tier 3
10 weeks EUC Tier 4

If you did not have a full 26-week claim, your weekly benefit remains at $180, number of weeks per tier are prorated based on original amount of claim, as follows:

September 2, 2012-January 5, 2013:* (& beyond)Tier 1 - 54% of original monetary determination (up to 14 weeks)
Tier 2 - 54% of original monetary determination (up to 14 weeks)
Tier 3 - 35% of original monetary determination (up to 09 weeks)
Tier 4 - 39% of original monetary determination (up to 10 weeks)

The weekly benefit rate remains the same throughout the life of the claim.

Tier benefits are a percentage of the original monetary determination, divided by the weekly benefit amount, to arrive at the actual number of weeks available per tier. A smaller claim may not receive the full 20/14/13/6 (before 9/2) or 14/14/09/10 (after 9/2) weeks, etc.
