This is a matter happening in California. A pal of mine was incarcerated for about three months. He did his best to meet bail so that he could get back to his job, but was unable to raise bail money. He kept in contact with his employer and used up all his vacation time hoping he would get out before his vacation time ran our and go back to work. Unfortunately, the vacation time ran out and then the employer sent termination papers to his home. When he was released, the employer liked him so much they asked him to come back and reapply for a job, but they then couldn't give it to him based on his conviction. So here's my question. Can he apply for unemployment? It's not like he purposely left his job and he did all he could do to get back to work. As I see it, he was basically fired. Any ideas out there? Thanks.
Technically he falls in the category of job abandonment - albeit unwillingly. He should apply, anyway. If he is denied, he should appeal. CA can be unpredictable in its decisions, depending on the ALJ.
