When filing a second benefit claim what earnings are used. I know they will use whatever is Available in your base year but will they also use your new earnings that were earned in your last benefit year, even if they do not fall in your base year? Also, I was not eligible for an extension in my first claim but if I meet the criteria in the second claim will I be eligible then or are extensions only available during your first claim. The state is NJ. Thank you in advance for your help.

Yes. You would not qualify for a new claim without those new earnings. It is called a requalifying claim. You MUST have worked to be eligible for a new claim. If you haven't yet read the NJ handbook, download it here:

EUC is not limited to the first claim. If base-year earnings in new claim equal 40x your weekly benefit, you will qualify for EUC.

Thank you so much for your response. I do understand that the only way I qualify for a second claim is because of those new earnings but I am wondering if they will calculate them into the amount of weeks I qualify for this new claim. They will not fall into my new base year but I did earn them in my benefit year. Again, thank you.

Thank you for your response. I had some confusion because I spoke with two different Nj unemployment agents last week. Both told me that they would only use the earnings in my base period and because my new earnings were not in the base period they would not use them, even though they were earned in the benefit year. I remembered reading here that they do include the benefit year earnings too. I wish the people that worked for unemployment would brush up on their skills. The answers I have gotten for some of my questions have been so far off base. Thank you for your knowledge!!
