In October I first filed a CA UI claim. I was terminted for misconduct. I filed an unemployment claim and was approved with a 5 week penalty. I served two weeks of that penalty. On 11/05/2012 I had to go on disabilty due to pregnancy. The UI office called me and I told them I was on disability due to pregnancy and would not be eligible for UI benefits. I was told once the disability was done to reopen my claim. On 03/19 repopened my UI claim and now received a letter stating that my claim is now denied due to the misconduct. How can it be denied if I was originally approved for it in October? ( I still have that approval letter). Should I call them or just file an appeal?

Sounds like an error. Not sure what you mean by refile. You already have an established claim on which you've served two penalty weeks. Were you filing claims during that penalty period? You should have been. You should have correspondence from CA which says something like this:

YOU ARE NOT ELIGIBLE TO RECEIVE BENEFITS UNDER CALIFORNIA UNEMPLOYMENT INSURANCE CODE SECTION 1257A BEGINNING xxxxxxxx UNTIL YOU HAVE FILED A CLAIM FOR EACH OF 05 WEEKS IN WHICH YOU ARE OTHERWISE ELIGIBLE FOR BENEFITS.

Call CA to straighten this out.

Thank you for answering. Yes when I filed my original claim in October I received paperwork that said I would have the 5 week penalty and they sent me claim forms with the XXXs marked out on them. I had to go on pregnancy disability and was told when that disability was over, I would have to refile/reopen the claim. So I did that online in March when the disability was over. They did another eligibility interview, in which I told them I was approved in October and was reopening. Than they sent a denial letter today. But if it was approved months ago and I just reopening it, why deny it now when it was previously approved? EDD is confusing but I will be calling them in the morning.

Was your misconduct penalty discussed during your interview? If not, it should have been. If the interviewer didn't bring it up, you should have in order to be sure both of you are on the same page. Sometimes not everything shows up on the screen the rep is using at the time. Had she known about the misconduct she might been able furthr research your claim and override the misconduct denial - because it wasn't a denial.
