I'm being laid off at the end of June. Just me, not a group of people. My position is being eliminated. I've been told that I will receive 4 weeks severance and that I will need to sign a release of claims letter in order to receive severance.

Things I know to watch out for:
- reasons for dismissal
- date for cessation of benefits
- confidentiality and non-compete statements

I will have a lawyer review it to cover myself, but I'm curious to know if there is anything else I should be watching out for.

And if I'm reading this correctly, in the state of MA, my severance pay may not disqualify me from Unemployment Insurance right away.

I also had to sign one of those forms before I received my severance - but unemployment delayed my benefit payments until after the severance (7 weeks worth) ... I'm in Colorado ... is each state different?

In Massachusetts, severance counts as "salary" if you don't sign a release letter. If you sign a release letter, I understand it's considered basically a payment for giving up your right to sue so it's not considered salary. It looks like that may actually be the case in Colorado as well if you're willing to fight it.

This article tells the story of a Coloradan who was able to argue successfully that he deserved UI despite his severance pay.
