The decision was reversed on March 11th and the employer filed an appeal on the 13th of March which he did not get until today. He has gotten all his retropay and was concerned now that he has to go to another hearing and say all the things he said the first time. Also this employer doesn't have to pay unemployment because he only worked there for 9 months so he wasn't eligible. So he is not sure why they are trying to appeal when the money came from an old claim. Now he is worried he will have to pay everything back if was to go to another hearing and lose. Anyone know why he received the copy of the appeal from the employer so many weeks later?

You have some holes in the story. 9 months employment is long enough for this employer to be on the hook for a decent chunk of the claim, so it makes total sense they'd appeal. Did he really have a hearing or was it a phone interview? There is more than one appeal available, but they are of a different type, and I can't tell just what kind of appeal this is because you're not being specific enough, but the cousin is in a much better position to describe things even if he doesn't use the right terminology.

He started in Dec of 2012 and was let go in Sept of 2013 and was told that he had to open up a old claim because he didn't work for that employer long enough. He was for fired wilful misconduct and was fighting to get EUC benefits from the old claim. It was a telephone interview since he was working at the time of the appeal. The decision was reversed on March 11th and it for EUC benefits for Tier 1 and 2 not a new claim which is mind boggling why they would appeal and nothing is coming from them.
I have a question. I was fired from work on Valentine's day this year. Had been employed a little over 3 years and the reason, i was fired misconduct of course. So done the telephone appeal and won. My questions are when will I begin to finally start receiving my benefits, and can and will my former employer appeal my won telephone appeals decision. Any help is greatly appreciated.

Employers will almost always appeal, the cost is little compared to a having to pay the claim. Having been involved in a few, generally there will be an independent mediator assigned, often by conference call hearing.
Employer appeals are barely 1/3 the number of claimant appeals. There's no reason to think that CA employers are in a minority, and that these statistics carry over to pretty much all the other states with little variation.
