I accepted a job offer with start date of May 2, pending background and drug test. I don't see an issue with any of that. My old supervisor told me he spoke to another company and they told him they would offer me their position. Since I accepted an offer already, can I reject this one whenever it comes my way? Or do I have to accept everything and go to the one that starts the earliest?

You don't have to accept anything when there is a contingency. On the flip side, if this potential new job has no contingency, then you need to review for suitability before you pass on it.

So move forward with both because I basically just have a "lead?" I am in NYS, so I am basically required to take anything within the last 13 weeks of UI, right? I have 6 weeks left I believe. I hate the idea of accepting the second job, and then likely refusing at the last minute when everything clears. It is a small company (1 employee start up), so I feel terrible doing that. I will accept it to cover myself.

I'd be honest with the second job offer and state that you are in the process with the first offer of being hired. Perhaps that position will stay open if the first falls through before hire for whatever reason. Good luck.
