Me and my fiance and her friend just signed a year lease less than 3 weeks ago. Now my finance and I have broken up and my apartment landlord said our only option is the huge Lease Break fee of 2 months rent and $500 and a 30 day notice. This would be approximately $900 per person to break!

My question is, I've read that by law they have to re-rent the unit quickly in the event of a lease break. Does this mean if they break the lease today, we all pay the fee and the unit is re-leased Monday that I get some money back, or am out that amount and my landlord just double dipped? Would I be better off to find new tenants myself and have the lease moved to them and NOT break the lease?

You would not be responsible for rent but you still have to pay the early termination fees. Fees are not the same as rent.

Yup. On this point the law is ultimately on their side. The fee applies whether they re-rent the property or not (if written into the lease you signed), and serves a variety of financial purposes, only one of which is to cover lost rent.

However, if you can find replacement tenants (for one or all of you) that may be a better option, though the downside of that is you'd have to sort out how to redistribute deposits amongst yourselves. Breaking the lease incurs a clear cost, but the upside is that it's "easier" for you in a number of ways.

$900 is a small price to pay to clear yourself of any future obligation with this property, or with your former future spouse. Pay it and move on. Think about what a future divorce could have cost you, including asset splits, potential child support, even alimony costing you thousands per month.
