if you get a 3 day notice and almost 4 weeks have gone by and you haven't been able to pay anything. Do they have to give another 3 day ago with a 30 day? I was laid off and filed for unemployment. I received an award letter then had a phone interview scheduled. I was told then my claim wad denied so I'm appealing it. In the mean time I let the rental office k ow what's going on but today they tell me they are not willing to accept my payments the 27th and 31st to bring me current. When I moved in things were broken and still are. I had a half working stove no oven. Fridge and freezer seals were busted kept loosing food and the microwave was broken. I also got roaches from the neighbor. I have complained about the roaches and broken stuff till I got tired of not getting anything done. Is there anything I can do?

Since they weren't willing to accept partial payments, you'll have to move, and it's just a matter of when. If it appears that you're not gonna move willingly, then they can get the sheriff out to remove you, but that requires obtaining a court-determined Judgment, a process which takes time and requires serving you a summons first, usually by a professional process server. All of which costs them money, so maybe they're just giving you a chance to move voluntarily rather than waiting until the "bitter end". BTW if there were problems with the unit, you should have provided the rental office with written notification earlier, before they started eviction proceedings for non-payment of rent.

If they are forced to go to court to evict you, be aware that evictions often become a matter of record in some areas, and that a Judgment will allow them to not only chase you down for any unpaid rent and court costs via creditors, but they can also garnish a portion of any future wages for the next 10 years. So if you need a little more 'time', probably better to arrange some sort of "negotiated" exit first. Good luck!

Still useful advice for anyone facing eviction (plus adding to old threads always seems to bug the heck out of some folks)!

Your problems with the place and your inability to pay the rent are two differant things. I would want to know what place in Ventura County offers a refrigerator and a microwave with the rental? I know of a few newer places that offer them but those are high end places and mostly newer places.

They do not have to give you another three day notice. That was taken care of.

You are saying that they will not accept your payments for the rent. These were full rent payments right?

Here is the deal. It sounds like since they will not take your money that you are going to be served an eviction notice soon. The reason that they will not take your money is that they have sent the matter to their attorneys.

What you need to start doing is packing your belongings. Your options are to move out now or wait till you are served. At that time a Sherriff, the building owner representative, and maybe a locksmith or building maintenance person will be there to lock you out of the place. You will be allowed to get your items out at that time but it is really back in the hands of the building owner or representative. Some will give you the time that day, but realize that they can stay with you during the process. They have a time frame to keep everything that they feel is of value for a period of 30 days. After that anything that is left behind can be thrown out.

Exactly what SOON2BNSURPRISE said. A smart management company will never accept partial payment. If they are also refusing full payment then they are set on evicting you. Unfortunately, that's what happens when rent is not paid.

You can try to contest using the broken appliances as ground for not needing to pay rent because the unit is not habitable. It may work with a pro-tenant judge. But hope for the best and plan for the worst, you need to come up with a backup plan now, and if you want to play it safe you may want to move out to another place immediately to savage your credit.

I am always surprised about all these full time students that can't work on the side and live off other people no matter what.

I work full time, go to college full time and suffer from chronic fatigue (always tired and sleep A LOT).
