If not can my lawyer make a deal with him over the phone before my trial date, or we have to talk to him in his office?

If every person could call the prosecutor to make a deal before the court date and without an attorney, the world would be different. No, you can't make deals over the phone.

Damn, I must have been really sleepy writing this one.

Your lawyer might be able to make a deal over the phone but I seriously doubt the prosecutor will talk to you VIA phone. If you hire a lawyer just listen to their advice.

If local then yes. If out of state I've seen plenty of cases where the lawyer appeared for their client.

I don't think out of state matters. If the you must appear box is checked you must appear.

OP, in the event you do make it back here, which I doubt, just check with your lawyer if you hire one. Many jurisdictions allow an attorney to represent their client with the client not present. They would check with the commonwealth attorney's office to confirm they will not be seeking jail time allowing the attorney to stand in for you. Happens in many court systems across the Commonwealth.
