I was recently involved in a conversation with a separated woman and the agreement she and her spouse had with the family home.

They co-own a home and she moved out (he refused to), so she is paying half of the mortgage and all of her own rent in her new place. I can't help but think that she is getting the short end of the deal on that. For example, if he also moved out then it would make sense that he would pay his rent and she would pay her rent. If they rented the house then those payments would easily pay the mortgage.

I guess you could say she is helping to pay for his cost of living by splitting his housing costs, whereis he is not doing the same for her.

Along those same lines when it comes to filing taxes will they both be able to deduct their share of the mortgage interest and taxes?

The obvious answer is to advise her to get an attorney. I'm just looking for others experiences with these issues, how they dealt with it and what the norm is these days.
