I lived in Montgomery County, Maryland from 1969 to 2000, and went to school there from the third grade. The county has evolved since I moved there in 1969. The county while boasting a very liberal progressive political agenda is very closed and segregated.

The County School´s Administration Building is housed in the Carver Center which used to be the old “Colored” High School in Montgomery County until Brown v Board of Education ended those practices. My mom taught in the county from 1972 from 1998 as a Reading Specialist and struggled to get proper funding for her programs that primarily served a minority population. She taught at what is now Westland Middle School in Bethesda and the school took on a huge minority population when Leland Junior High closed in the mid 1980´s. Only when minority test score gaps between the white students became embarrassing to the “progressive” county did the school board become interested in closing the gap. What the current practices are with the education system there are not known to me as she retired almost ten years ago.

I always thought of Montgomery County as a very open county that ran a pretty good government until 1996 when I got an inside view of the establishment. I had become involved in my Homeowners Association´s Board of Directors (Tanterra) which is in Brookeville and they operated a swimming pool where to this day Beer is served every Sunday afternoon courtesy of the Tanterra Volley Ball Committee it was once called the Tanterra Beer Volleyball Committee and even sold T Shirts with that exact name on it. The practice of selling T Shirts with the name “Beer Volleyball” on it ended in 2000 because of several problems.

The primary problem was the Tanterra Homeowner´s Association had not held quorums for two prior years during their annual meetings and a group of homeowner´s ran a slate of candidates that made it their clear intention to end the serving of ANY alcoholic beverages at the pool when children were there. The candidates basically lost because the established board made it very difficult for the challengers to run including not placing their names on the ballots and other heavy handed practices. The association even went as far to pay for campaign literature for their candidates who favored the continued practice of serving alcoholic beverages with kids present the law was also clear Association Funds were not supposed to pay for any campaign literature.

Basically after the loss of the elections the group of candidates regrouped and we started a review of the county laws and found out that serving any alcoholic beverage required a license by the server and that that the board was not to serve or allow to be served any alcoholic beverage because they were operating with a pool license. The Board of License Commissioners was called they are the county agency who handle the regulation of the sale and serving of alcohol in the county and we were told that the Police should be contacted should violations of this law occur.

We contacted the Police and were told the Police would be visiting and arresting the servers of the alcohol at an upcoming party. Basically what happened is the Board of Directors became aware of the visit and moved the location of the party to a residence that backed up to property owned by the association. I contacted the Police Officer that I had spoken with and was told he would be taking care of it. Nothing ever happened and when I showed him the newsletter where the Board of Directors bragged about having the party he told me unless he saw it with his own eyes he couldn’t do anything. My attorney told me that was not correct the newsletter would be sufficient evidence to open an investigation. What we later found out is that one resident who was a Police Sergeant had gotten the officer to look the other way. However, after that party the Board stopped serving alcohol during pool hours and admitted they were breaking the law. The law was clear at that point alcohol could not be even stored on the premise let alone consumed. What started happening was groups of individuals with Board members would go up to the pool house and drink beer and play cards during the winter so we started calling the Police and they would do nothing even after I informed them of the associated laws.

In 2000 the Board started serving Alcohol again at the pool during operating hours under the license of a local restaurant they basically bought the beer from them and brought it out to the pool. This was still not legal under current law as the law was clear the board could not even allow beer to be served on a premise that had a Pool Operators License. It was at this point, that I had my lawyer send a letter to the Board of License Commissioners which refused to do anything. The County in 2002 changed the law to allow the issuance of temporary licenses for twenty separate times that would last 24 hours to Homeowner´s Associations. I had moved by this time and lost interest it was my understanding that basically the Tanterra Board of Directors had certain members lobby the County Council for the bill.

Right after I had my Lawyer sent the letter to the Board of License Commissioners I got notice that I was being charged with theft of a computer. The Board’s President and the Board had authorized me to donate the computer in writing and we informed the States Attorney of this and they pursued the case anyways. On the day of trial we had subpoenaed the Board President to appear in court who claimed he had a government travel order for travel and didn’t appear so the letter was not allowed as evidence and the Board members present insisted they had never authorized me to donate the computer so I was found guilty. Basically I was given probation before judgment and paid a fine of $300 dollars and I told my lawyer to appeal the case. In signing the document accepting the probation before judgment I gave up my right to appeal but my Lawyer didn´t tell me that. I did see in the document that I was waiving the right to appeal and questioned this with my lawyer he told me this is why we are going to appeal just sign it. When I contacted him a month later about the appeal he wouldn’t return phone calls. I later found out the President didn’t have ANY travel orders and when I confronted the lawyer about this he denied that I had specifically given him any instruction to research the claim of a travel order or that I had asked him to appeal the case.

When I went to have charge removed from my criminal record in 2004 the lawyer who handled it told me basically the thinks the county had grown tired of me complaining and used the criminal charges to sort of send me a warning. I made two mistakes with the criminal charges, first I should have insisted my lawyer get a new trial date because the President of the Board was absent for a reason basically the letter was considered hearsay and could not be admitted unless the President would either admit or denied he sent the letter. I should have gotten written proof that the claim that a travel order was supposedly in effect was genuine. Oh well life goes on.
Today the drinking still continues there but this is some insight into how a supposedly “progressive” county operates. I remain firm in my belief that drinking at a public swimming pool with kids present is a bad idea. I also think this is very telling in how a well connected group of people can use county government to bully their way thru.

I received a great education in Montgomery County and I am forever thankful for that. However, my belief in our justice system and the police has been forever changed. I will be returning to the District area in a few months and I will not moving to Montgomery County I will probably move to Northern Virginia

Oh my God! Beer! On a Sunday! The horrors!!!!!

Last I checked, drinking a few beers on a Sunday afternoon while watching sports or otherwise recreating is pretty much what Americans do. I remember playing in a softball league on the national mall where kegs would be set out at second base.

You've got issues. Help stop the genocide in Darfur or something.

I have no problems with consuming Beer but this is what we have homes for to do it at a community pool where kids are present is not appropriate. Furthermore, for a group of people to use the Police to circumvent the laws with the local Police and State´s Attorney Office is not what America is about.

I would point out to you that NO POOL IN MONTGOMERY COUNTY serves Alcohol during the day while the pool is open except for Tanterra. Some pools will have parties at night and serve it, however, nobody is allowed into the pool.

Hi,

I agree with you. Beer, swimming, and children don't mix. Do you have any information about the current Tanterra Board of Directors and their connection to the County? It seems like the Tanterra Board is still acting in a heavy hitting manner on a number of issues related to the neighborhood.

So let me see if I have this straight.

ABout 10 years ago, you got upset with the serving of beer at a homeowner association-run swimming pool in a small enclave of houses in a small suburb north of Olney, and because of that you are convinced that:

1. The Board of Directors of the HOA is corrupt.

2. The Montgomery County Police Department is in cahoots with the HOA.

3. The Montgomery County D.A. somehow is also tied into this by falsely prosecuting you for theft of equipment from the HOA.

4. Your attorney was incompetent and had you sign away your rights.

5. Even though you moved away from MoCo in 2000, this beer issue concerns you to such an extent that you still keep tabs on what is going on in Tanterra.

6. A decade after this all transpired, you are still so worked up by what happened in the 1990s that you are going to move to VA upon your return.

I have just one thing to say about this:

God help the poor, unfortunate homeowners in whatever neighborhood you move to in VA.

Oh, you mean the way you attacked in a public forum the Tanterra Board of Directors, the Montgomery County Police Department, and your defense attorney? Not to mention impugning the integrity of the district attorney's office, the Montgomery Council Board of License Commissioners, and the County Council?

You've basically stated that the entire government operation of Montgomery County is corrupt. And all because you have some unhealthy fixation with the fact that some homeowners drink beer near the community pool on Sunday afternoons in the summer.

And actually, this isn't about drinking near the kids at all, is it? Because you also stated that you called the police when the homeowners drank beer while playing cards in the dead of winter with nary a child in sight (since the pool is only open from Memorial Day to Labor Day).

You must shed a tear every year on December 5th.
